American and Aero California are planning to implement their code share agreement by August 1, 1997, and require several months to arrange for that implementation. Accordingly, they request expedited approval of this Application so that advance marketing and sales of the proposed services can commence as soon as possible and the public can begin to benefit from the enhanced competition that will result from approval of the Application.

Joint Application for Transfer of a
Foreign Air Carrier Permit
The Joint Applicants request transfer of ALM's foreign air carrier permit to ALM 1997 thereby authorizing ALM 1997 to engage in scheduled and charter foreign air transportation of persons, property and mail. As explained, ALM 1997 intends to provide scheduled foreign air transportation as the corporate successor to ALM, following a re-organization of ALM that the Government of the Netherlands Antilles has decided to undertake. ALM 1997 intends to operate ALM's current schedule as soon as possible so as to maintain uninterrupted service between the Netherlands Antilles and the United States.

Applies for exemptions from 49 U.S.C. § 41303 to the extent necessary to provide scheduled foreign air transportation of persons, property and mail between (1) a point or points in the Netherlands Antilles; the intermediate points Aruba, Santa Domingo, Dominican Republic; Port-au-Prince, Haiti; and Kingston and Montego Bay, Jamaica; and the co-terminal points Miami, Florida; New York, New York; and San Juan, Puerto Rico; (2) Curacao and the terminal point Ft. Lauderdale, Florida, via the intermediate point Aruba; (3) Curacao/Bonaire and the terminal point Atlanta, Georgia via the intermediate point Aruba; and (4) Curacao/Bonaire and the terminal point Miami, Florida via the intermediate point Puerto Plats, Dominican Republic. ALM 1997 also requests an exemption from § 41303 to the extent necessary to operate passenger or cargo charters to and from the U.S. in accordance with Part 212 of the Department's Regulations.

Motion to Withhold Informaiton from
Public Disclosure
Both ALM 1997 and ALM are majority owned by the Government of the Netherlands Antilles. Because of the significant operating loses ALM has incurred over the past 20 years, the Government has decided to restructure ALM, and has formed ALM 1997 to assume responsibility to provide the air services ALM currently operates.

American Airlines, Inc. (Exemption, US-Mexico and Route Integration, Code Sharing with Aero California)

Although the U.S.-Mexico bilateral agreement restricts entry on each transborder gateway route segment to one carrier from each country, the agreement explicitly provides a mechanism by which both countries may agree to designate an additional airline. Under this provision, the U.S. and Mexico have agreed to dual designation on more than 100 such gateway route segments. To the extent that additional designations are required for code-sharing services on routes that only have single designations, American and Aero California will request dual designations through an exchange of notes.

Continental Airlines, Inc. (Exemption, Newark-Caracas)

Continental plans to institute daily Newark-Caracas B-737 service on April 5, 1998. Since Continental already holds authority between Houston and Caracas and plans to institute nonstop Houston-Caracas service beginning December 15, 1997, Continental seeks Newark-Caracas authority so it can begin advertising and marketing both Newark and Houston services well in advance of the start-up of Continental's Houston-Caracas service. By operating complementary Caracas services at both the Houston and Newark hubs, Continental will be able to provide a comprehensive pattern of U.S.-Venezuela service options for travelers and shippers throughout the United States and compete effectively with American's Miami hub and United's Miami gateway as well as competing with those carriers' services at JFK.

Gof-Air, S.A. de C.V. (Exemption, US-Mexico Charter Air)

Gof-Air received its DGAC permits and commenced flight operations in August 1996. Using a single business jet aircraft from its base in Toluca, Mexico, Gof-Air provides worldwide air transportation to, inter alia, executives and guests of Comercial Mexicana, S.A. de C.V., a large retail supermarket chain in Mexico. Future operations, including its proposed U.S. service, are likely to be a continuation of this type of operation, i.e., highly personalized service to executives and their invitees using business aircraft. Gof-Air estimates that it will operate 20 roundtrips between Mexico and the United States annually with an average load of six passengers per flight; almost all of this traffic will originate in Mexico

Air Carrier Fitness
Although the applicant has provided an update on its capitalization and financing, the Pro Air did not provide independent third-party verification of such funding and a revised list of preoperating expenses already paid and those remaining to be paid. In the show-cause order startup costs were estimated to be $1.5 million with another $4.5 million in expenses during three months of normal certificated operations. It now appears that pre-operating costs alone will be in excess of $3.5 million and we are unsure as to what additional pre-operating expenses will be incurred or what the expenses will be for three months of normal operations. Thus, it is unclear as to what would be required for the working capital reserve. Since we must make a finding that Pro Air continues to meet our financial fitness test, please provide information which will clarify this matter.

SARSA also requests stopover privileges and renewal of its relief from the requirement to obtain advance approval for each Mexico-U.S. flight.

Support (Dated May 6, 1997)
The City of Chattanooga and the Chattanooga Metropolitan Airport Authority (Chattanooga Parties) urge the Department to grant the application of Trans States Airlines, Inc (Trans States) in Docket OST-97-2368. Trans States seeks exemption authority to operate Inter allia four roundtrips in the Chattanooga Chicago O'Hare market. The proposed service would provide substantial benefits to the traveling public while addressing the desire of Congress that the Secretary "make the fullest possible use of existing exemption powers" to increase access to O'Hare for small and medium sized communities.

Answer of the Roanoke Regional Airport
Commission (Dated May 5, 1997)
Roanoke Regional Airport has lost nonstop Chicago O'Hare service twice since airline deregulation began, due in part to the artificial constraints imposed through the slot allocation process at Chicago O'Hare. Piedmont Airlines had a long history of service to Chicago O'Hare from Roanoke' beginning in the 1960s and ending in the early 1980s. United Express carrier Air Wisconsin then followed with nonstop jet service to Chicago O'Hare beginning in March 1988. As a codesharing partner of United Airlines, this service proved popular and was widely supported by the community. Unfortunately, despite its success, this quality service was discontinued in September 1992 following United Airlines' purchase of Air Wisconsin and its valuable O'Hare landing slots.

Response to USTAR's Comments
The new rules attempt to reconcile the two different pricing approaches being used by computer reservations systems (CRSs) to calculate normal fares with multiple segments for international journeys. Some CRSs use the traditional "journey" concept which treats the fare for a multiple segment itinerary as a single unit, and applies various fare checks to prevent the constructed through fare from undercutting fares between individual points along the itinerary.
