Third-country codesharing should be included in any blanket statements of authorization.  In this regard, American endorses the position taken by Northwest in its answer of February 3, 1998 to American's Petition for a policy statement to establish indefinte duration for certain authorities.

As Northwest notes, a model condition along these lines appears in the route integration authority granted to United by Order 97-6-16, June 10, 1997 (OST-97-2126)

Specifically, Northwest requests that the Department include the condition that United and Lufthansa give advance notice before beginning any new codeshare service. In their joint application dated January 26, 1998, United and Lufthansa indicated that they would comply with a condition requiring the carriers to notify the Department 30 days before they begin any code-share service in a new market not previously authorized, See Joint Application, p. 5. Any additional notification requirement is, therefore, unnecessary.

These third-country points were inadvertently omitted from the list attached to the joint United/Lufthansa application dated January 26, 1998, in which renewal was sought for various outstanding statements of authorization. The statements of authorization previously issued for these points would have expired on May 29, 1998 absent renewal. We understand that services to these points are now covered by the blanket statements of authorization and need not be specifically renewed.

Re:  Concern of Continental Airlines

Continental Airlines does not object to the January 10, 2003 notice of United and Lufthansa regarding additional codesharing, although Continental remains extremely concerned about the continuing expansion of codesharing by incumbent airlines at London Heathrow so long as Continental and other U.S. airlines are precluded from effective entry at London's Heathrow airport. 

United is one of only two U.S. airlines authorized to operate at London Heathrow, and it has been allowed to codeshare at London Heathrow with bmi British Midland, the second largest U.K. airline at London Heathrow, on routes between that airport and points in continental Europe. Lufthansa is one of the largest European airlines serving London Heathrow, and United and Lufthansa hold antitrust immunity for their combined operations as well as for the operations of SAS, Austrian, Lauda and Air Canada at London Heathrow. As a result, the Star Alliance airlines, bmi British Midland and United are further entrenching their operations at London Heathrow while operations by Continental and other U.S. airlines are completely forbidden there.

Although Continental is not objecting to codesharing between United and Lufthansa on the London Heathrow-Dusseldorf route, Continental remains extremely concerned about actions by the Department which strengthen the positions of incumbents and their alliances at London Heathrow without securing effective access and facilities there for Continental pursuant to a "transformative" U.S.-U.K. Open Skies agreement.

Pursuant to the blanket Statements of Authorization granted to United Air Lines, Inc. and Deutsche Lufthansa AG by Order 1998-4-8 issued April 9, 1998 (Undocketed), Lufthansa CityLine GmbH by Notice of Action Taken dated July 15, 2003 (Docket OST-2003-15485), and Air Dolomiti SpA Lare by Notice of Action Taken dated April 17, 2002 (Docket OST-2002-11856), and the blanket exemption granted to United for worldwide code-sharing on flights operated by Lufthansa and Lufthansa CityLine (Notice of Action Taken dated January 24, 2005, Docket OST-2004-19148), United and Lufthansa hereby notify the Department that, effective on or after February 2, 2006, United's "UA" designator code will be displayed on flights operated by Lufthansa, Lufthansa CityLine or Air Dolomiti between:

To the extent necessary, United, Lufthansa, Lufthansa CityLine and Air Dolomiti request a waiver of the 30-day notice requirement. The code-share flights to Pisa are replacement flights for services currently being operated to Florence. The carriers have been advised by the Italian authorities that, effective February 2, 2006, flights to the Florence airport will be temporarily rerouted to Pisa due to runway construction at Florence. The proposed code-share services are consistent with the bilateral air transport agreements between the United States and Germany and Italy.

United. Lufthansa and Air Dolomiti have previously given notice to the Department of code-share services between Munich and Pisa, but are jointly giving this notice as these routes may now also be operated by Lufthansa CityLine on Lufthansa's behalf.

DOT Letter - Cannot Proceed with Codesharing as Reflected in March 16, 2007 Notice

We are in receipt of the March 16, 2007, 30-day notice submitted on behalf of United Air Lines, Inc. notifying the Department of the carrier's intention to display United's "UA" code on flights operated by Lufthansa German Airlines on flights between Frankfurt and Munich. Germany. on the one hand, arid the following points in Spain, on the other hand: Barcelona and Madrid. Unfortunately, the current V.5.-Spain aviation agreement does not allow U.S. carriers to serve Spain via Germany as an intermediate or beyond point. As a result, we hereby put United on notice that they cannot proceed with their plans as reflected in the March 16 notice.

We note that the European Community Council of-Transport Ministers has approved the firstphase United States-European tInion Air Transport Agreement. which will establish open skies between the United States and all 27 LU member states. When an open-skies relationship is being applied between the United States and Spain, carriers will no longer be limited in terms of named intermediate or beyond points. At this time, however, please he advised that the Department is not prepared to approve the proposed services.

Comments of United Air Lines

This will acknowledge receipt of the referenced letters directing United not to proceed with implementation of new code-share services to Madrid and Barcelona, Spain with its partner carriers Lufthansa German Airlines and Swiss International Air Lines, Ltd. These services would have operated via points in Germany and Switzerland, respectively, on a blind sector basis under the UA* designator code between those countries and points in Spain. Your directive is based on the premise that these services would not be consistent with the U.S. carrier route description in the current U.S.-Spain ASA that remains in effect until March 30, 2008, when it will be replaced by an open skies regime.

United does not agree with your underlying premise. Because the services in question will not carry any local traffic under the UA* code between Germany or Switzerland and Spain, there is no need for these blind-sector connection points to be named on the U.S. carrier route. While we concede that Spain has taken a contrary position, the U.S. has heretofore disagreed. Thus, your department has twice before authorized United to offer code-share service on a blind sector basis between London (a point not on the agreed U.S. carrier route to Spain) and several points in Spain. All points in Spain authorized for such services have been named on the agreed route, just as is the case in the notices covered by your referenced letter.

Nevertheless, in recognition that Spain has taken a contrary position, and in view of the fact that the U.S. may wish to wish to maintain the status quo pending a possible agreement by Spain to accelerate the date for applying open skies terms, United is willing to waive whatever objections it may have to the directives in the referenced letters. Based on informal discussions with Spanish officials in advance of the recent U.S.-E.U. negotiations, it appears that Spain may, indeed, be willing to advance the date for applying open skies terms for U.S.-Spain services. We will therefore defer any implementation of the proposed code-services pending the applicability of open skies provisions between the U.S. and Spain consistent with your referenced letters.

We assume in taking this position that your department will take similar action with respect to any other proposed code-share services between the U.S. and Spain or any other E.U. country, including but not limited to the services proposed by Delta and Alitalia in their March 19, 2007 Notice in Docket OST-2001-10417 and any extra-bilateral expansion of services by American and Iberia or Malev such as those described in their Comments in Docket OST-2000-6939 and Supplement in Docket OST-2006-26737, respectively, both dated March 23, 2007.

The proposed code-share service noted above is fully consistent with the applicable bilateral agreements. United and Lufthansa intend to implement these services on or after December 15, 2007, the expected first date of operation for United’s new LAX-FRA service.
