Re:  Application for Renewal and Amendment of Statement of Authorization - US-Canada (Air Canada Codeshare)

When United filed to renew these two authorities on May 31, 1996, United also sought an amendment so as to make it explicit that the "AC" designator code could be displayed on all transborder flights operated by United and not just on those that were in operation or specifically requested at the time that the initial applications were filed. 'This amendment allowed United to have the flexibility to engage in additional code-sharing consistent with the U.S.-Canada Air Transport Agreement, without seeking additional route-by-route approvals. A similar amendment had been granted to American Airlines, Inc., and Canadian Airlines International by Notice of Action Taken, dated April 18, 1996, in Docket OST-95-792. United now seeks renewal of this existing authority as amended.  United also requests a further amendment of its statement of authorization to allow it to display Air Canada's code on beyond-gateway flights within the U.S. to any U.S. point United is authorized to serve.

Service List

United and Air Canada plan to begin code-share service to Mexico City starting on January 25, 1999. In these circumstances, and because authorization is consistent with DOT policy, United seeks expeditious approval of this statement of authorizations.

For the reasons stated above, United requests approval of this statement of authorization for an indefinite period subject to the normal conditions. Approval of this statement of authorization would be fully consistent with the public interest, and is authorized under applicable bilateral air service agreements.

American Airlines, Inc. hereby answers the captioned application submitted on December 29, 1998 by United Air Lines, Inc. seeking a statement of authorization under 14 CFR Part 212 to display the "AC" designator code of Air Canada on United's flights between Chicago, Los Angeles, San Francisco, and Washington, D.C., on the one hand, and Mexico City, on the other. American is this day filing a similar application for a stateme:nt of authorization to display the 'CP" designator code of Canadian Airlines International Ltd. on flights operated by American between Chicago, Dallas/Ft. Worth, Los Angeles, and Miami, on the one hand, and points in Mexico, on the other, on a blind sector basis for passengers traveling between Canada and Mexico. American proposes to commence such codesharing service on January 17, 1999, and is requesting approval on an expedited basis.

The code-share services will be operated as part of United's mainline operations in conjunction with United's new United Express code-share arrangements with Air Wisconsin, Chautauqua Airlines, Mesa Airlines, Republic Airline, Shuttle America, SkyWest Airlines, and Trans States Airlines. United plans to operate code‑share services under this notice as necessary to supplement its United Express commuter operations. To ensure no disruption in service to passengers traveling in these markets, United is giving this notice now to cover services it may be called on to provide in United Express markets. The notice will be effective for United services operated on and after October 9, 2004.

Hereby notifies the Department that United intends to display the designator codes of these foreign carriers on flights it operates between and among the U.S. cities listed in Exhibit A hereto. In addition, United hereby notifies the Department it intends to display the codes of these foreign carriers on flights it operates between any of the U.S. cities listed in Exhibit A hereto and any of the Canadian cities listed in Exhibit B hereto.

The code-share services will be operated as part of United's mainline operations as well as its United Express code-share arrangements with Air Wisconsin, Mesa Airlines, SkyWest Airlines, and Trans States Airlines. Docket OST-04-17986). This notice will enable United and United Express carriers to operate code-share services interchangeably to the points listed without the need to file repetitive notices as connecting services shift from one carrier to another.

United has not included Air Canada in this notice as it has authority to display Air Canada's designator code on all U.S-Canada transborder flights operated by United and on flights operated by United beyond any U.S. gateway to any U.S. point. See Statement of Authorization #98-54, June 12, 1998 (Undocketed).

(August 7, 1998, Undocketed), Asiana Airlines (December 19, 2002, Docket OST-2002-13320), Austrian Airlines, Osteneichische Luftverkehrs AG (March 13, 2000, Docket OST-2000-6803), British Midland Airways Limited (December 3, 2003, Docket OST-2003-15758), Deutsche Lufthansa AG (April 9, 1998, Undocketed), Qatar Airways, Q.C.S.C. (July 19, 2007, Docket OST-2007-28628), Scandinavian Airlines System (May 24, 1999, Docket OST-1999-5251), TACA International Airlines, S.A., and Lineas Aereas Costarricenses S.A. (May 18, 2006, Docket OST-2006-24078), United hereby notifies the Department that United will display the designator codes of these foreign carrier partners on United's flights between and among the cities listed in Exhibit A hereto.

United and its foreign code‑share partners have previously filed most of the cities referenced in Exhibit A with the Department in the above‑referenced proceedings. Since the purpose of this notice is to update the list previously provided to the Department, the entire list is being refilled for ease of reference. To the extent that any of the cities included in this notice have not been previously noticed to the Department, code‑share service to those cities will not be implemented for a period of 30 days following the filing date of this notice.
