Answer of Korean Air Lines to United Air Lines

United requests the Department to disapprove the above referenced joint applications of KAL and Delta. United states this action is justified, including the termination of existing code-share operations in the Atlanta/Chicago-Seoul, Washington, D.C./New York-Seoul, and Los Angeles/Honolulu-Seoul markets, based on comments which United claims were made by representatives of the Government of Korea at the U.S.-Korea aviation negotiations recently held in Seoul, Korea. United states in its letter that the Korean Government has taken the position it will not accept the so-called "third country" codeshare provision of the "model" U.S. "open skies" agreement.

Termination of the existing code-share services of Korean Air and Delta, in the above-described markets, would adversely affect the traveling public, with particular disruption during this heavy travel season. Yet United asks the Department to take this severe step without any proof of actual harm to United. United's letter is silent as to any third-country code-share service which United intends to operate via Korea. Korean Air is not aware of any announcement of such service, nor of any application which has been filed by United and another carrier for code-share services via Korea.

Delta and Korean Air Lines hereby jointly apply for a Statement of Authorization under Part 212 of the Department's Regulations to enable Delta and KAL to implement code-share/blocked-space service between Boston and New York (JFK) on the one hand, and Seoul, South Korea, on the other hand. KAL will provide to Delta a certain number of seats for marketing and sale by Delta under Delta's "DL" designator code on flights operated by KAL between Boston and Seoul, via New York (JFK). Delta and KAL request that this application be approved no later than November 1, 1996, effective for a period of at least one year.

Codeshare will enable Delta and KAL to implement code-share/blocked-space services over the following routes:

KAL will provide to Delta a certain number of seats for marketing and sale by Delta under Delta's "DL" designator code on flights operated by KAL between the above named U.S. points and Seoul, South Korean Delta and KAL request that this application be approved by no later than November 1, 1996, and be effective for a period of at least one year. On or about December l, 1996, Delta proposes to implement New York(EWR)-Seoul and Anchorage-Seoul service pursuant to a code-share/blocked-space arrangement with KAL under which Delta will list its designator code on KAL's flights. Delta does not currently serve Newark-Seoul or Anchorage-Seoul. KAL operates three weekly roundtrip flights on a New York (EWR)- Anchorage-Seoul routing, using Boeing 747-400 aircraft, and also operates to Seoul via Anchorage to additional U.S. points.

Pursuant to the blanket statement of authorization issued August 6, 1998 (#98394), Delta and KAL hereby notify the Department that Delta intends offer codeshare service on flights operated by KAL between Seoul and the following additional points in Asia:

Delta wishes to begin offering the new codeshare services as soon as possible after November 1, 2002. Accordingly, Delta requests at waiver of the 30 day prior notice requirement, but will not implement service until the earlier of 30 days from the date of this Notice or confirmation of the Department's agreement with this request. The proposed service points are unrestricted with respect to U.S. carrier third-country codesharing and involve points with existing U.S. flag direct and/or codeshare operations.

This is to confirm that Delta's October 23, 2002 Notice concerning codesharing to Hong Kong, Bangkok and Auckland, consistent with the terms of Delta's blanket authority, applies to the open-entry codeshare rights available. under the applicable bilateral agreements. Should Delta desire to exercise fifth-freedom privileges at Hong Kong or Bangkok, Delta will apply for the appropriate limited-entry authority as required.

Delta wishes to begin offering the new codeshare services as soon as possible after December 1, 2002. Accordingly, Delta and KAL request a waiver of the 30 day prior notice requirement, but will not implement service until the earlier of 30 days from the date of this Notice or confirmation of the Department's agreement with this request. The proposed service points are unrestricted with respect to U.S. carrier third-country codesharing and involve points with existing U.S. flag direct and/or code share operations.
