Delta and Air France intend to commence such code-sharing services on June 1, 1998, but plan to open such services for sale to the general public as soon as possible but no later than April 30, 1998, subject to the receipt of all necessary approvals. Air France and Delta therefore request that the Department grant the statements of authorization requested for an indefinite period as soon as possible but no later than April 30, 1998.

On April 22, 1998, United filed a consolidated answer to the Joint Applicants' docketed exemption applications (Dockets OST-98-3739/3740/3744) seeking underlying authority for the proposed code-share operations, which answer United incorporates herein. In summary, United has no objection to expeditious action on the code sharing authorizations of the Joint Applicants so long as the new Departmental authority requested by United to support its code share service to France (Docket OST-98-3732) is approved no later than that of the Joint Applicants.

Moreover, prompt approval of this application will allow both Delta and Air France to enjoy the benefits available to U.S. and French carriers under the recently concluded MOC to the fullest extent possible.

Continental and Air France will apply shortly for blanket code-share authority which will permit them to implement fully their code-share alliance and enjoy the maximum code-share benefits available to U.S. and French carriers under the new U.S.-France Memorandum of Consultations. Continental has no objection to the Department's approving the Delta/Air France request for blanket code-share authority as long as the Department is prepared to award the same blanket authority to Continental/Air France without delay.

United urges the Department to reflect carefully upon the policy implications of the joint Delta/Air France request for blanket statements of authorization. The authority which those carriers are requesting would represent a virtual elimination of the requirement for prior approval of code shares without regard to the nature of the bilateral agreement on codesharing that the U.S. has concluded with a foreign carrier partner's homeland. The Department should not grant approval for such blanket authority for Delta and Air France unless it is prepared to do so for other similarly situated carriers.

Contrary to United's assertions, the Delta/Air France application is fully consistent with the Department's prior grant of blanket statements of authorization. There is no question that both the underlying route rights as well as the right to provide services through cooperative service arrangements are available under the bilateral. Other U.S. carriers are free to code-share beyond France with third country carriers, and limits on the number of U.S. carriers authorized for intermediate point code-sharing to France are mostly optical.

We reject arguments that we should adopt a laissez-faire approach to exclusive dealings between and among airlines in international air transportation. It is not in the public interest to ignore any feature of a code-share agreement that could interfere with competition or otherwise undermine the ability of consumers to benefit from the opportunities created by our aviation relationships. For that reason, we will continue to assess the merits of code-share exclusivity provisions on a case-by-case basis in light of the terms of the overall arrangement and of the special facts and circumstances affecting each market, such as its structure, the positions of the parties in those markets, and the nature of the bilateral aviation relationship governing it.
