Order 01-02-01 Issued and Served February 1, 2001 We propose to make available for each calendar month remaining in the charter year (March--June) a pro rata portion of the charters that were in the charter pool as of January 25, 2001, i.e., 21 charters each month.' All eligible carriers interested in using the charters would be able to apply as set forth below for the available charters. We propose to distribute the available flights each month by dividing the number of available flights equally by the number of eligible applicants to the extent that such allocations are equal to or fewer than requested, and to distribute the remaining flights using a round-robin procedure on a first--come, first-served basis. 2 Consistent with our current procedures, carriers allocated flights each month would be required to report the number of flights used no later than the tenth of the following month. We propose that any flights returned would be available for the charters that can be applied for in that month of the return. For example, reports for charters distributed for February operations would be due by March 10. Under our proposed procedures, applications for charters to be operated in April would be due by March 15. Thus, any charters distributed for February and returned in March, would be added to the number of charters available for distribution for April services. By: Paul Gretch
Order 01-02-14 Issued and Served February 14, 2001 We have decided to make final the procedures proposed in Order 2001-2-1 for distribution of the U.S.-Brazil all-cargo charters available for the balance of the charter year (March through June 2001). No party has opposed the need for special procedures or our decision to pro rate the number of charters available and to distribute them equitably among interested carriers. Rather, the commenters have sought certain modifications and clarification to the proposed procedures. Specifically, we replaced our year-to-year comparative allocation proceedings with streamlined advanced allotment/charter pool procedures. Under these procedures, a portion of the available charters is allotted in advance to carriers that have operated an average total of at least 20 charters over the previous two calendar years. The balance is maintained in a charter pool for distribution on a first-come, first-served basis. We stated that, prior to the beginning of each charter year, we would issue a notice announcing the advance allotments to qualifying carriers for the upcoming charter year. By: Read C. By: Karan Bhatia Brazil Cargo Charter Authorizations 2005/2006 Served May 24, 2005 e issue an advance allotment of 119 flights to Florida West International Airways for all-cargo charter operations for the 2005/2006 charter year (July 1, 2005 - June 30, 2006). The remaining 631 charters are reserved in a charter pool for distribution on a first-come, first-served basis. Arrow Air operated 384 flights over a two-year period, for an annual average of 192 flights. Under our procedures, Arrow normally would qualify for an advance allocation. However, by Order 2005-3-31, Arrow was awarded certificate authority for scheduled all-cargo service between Miami and Brazil, and was allocated five weekly frequencies for its services. Therefore, it is not eligible for an advance allocation here. See Orders 98-4-19 at 4 and 6, and 98-6-14 at 4. The advance allotment issued by this notice and flights operated from the charter pool for operations in the 2005/2006 charter year are subject to the conditions and procedures established for such flights in ordering paragraphs 4 through 8 of Order 98-6-14.
