We have decided to grant Aerolitoral authority to wet lease small equipment to Aeromexico through July 8, 1999, coextensive with Aeromexico's underlying authority to conduct scheduled operations in the Monterrey-Brownsville market. We find that the proposed operation meets the requirements of Part 212 and is in the public interest.In taking this action, we note that our overall aviation relationship with Mexico supports grant of this authority and note that there is no evidence in the record of this case showing that Mexican authorities would act unfavorably on analogous wetlease requests by U.S. carriers, or would limit durations of such authority to only six months. We also note that the operation proposed by Aerolitoral will enable Aeromexico to conduct bilaterally-agreed services in the U.S.-Mexico market.As a final matter, we emphasize that we share Northwest's desire for an acceptable code-share arrangement with Mexico. Moreover, we expect favorable action on analogous wet-lease requests filed by U.S. carriers with the Government of Mexico. Should such favorable action not be forthcoming, we reserve our right to alter our decision in this case.

Aerolitoral and its predecessors traditionally operated small aircraft such as Fairchild Metro III, Saab 340B, and Embraer ERJ 145 aircraft with less than 60 passenger seats. As a result, all authority Aerolitoral applied for and received from the Department was limited to operations using small aircraft. However, to Aerolitoral's knowledge, its designations under the U.S.-Mexico bilateral aviation agreement, as amended, do not include such a limitation, nor is its homeland economic authority so limited.
Aerolitoral now has added its first large aircraft, an Embraer ERJ 190-100LR aircraft (which is advertised by Embraer with configurations ranging from 94 to 114 passenger seats) to its fleet of 33-seat Saab 340B and 50-seat Embraer ERJ145 aircraft. The first ERJ190, registered in Mexico as XA-AAC, and additional ERJ190s will be subleased from Aeromexico, which in turn is leasing them from Celestial Aviation Trading 15 Limited of Ireland. Heavy maintenance for these aircraft will be provided by Embraer Aircraft Maintenance Services, Inc., which holds the necessary DGAC authorization, and Aerolitoral mechanics and local contractors will provide line maintenance.

Application for Renewal of Wet-Lease Statement of Authorization
On June 13, 2007 the Department issued Aerolitoral, S.A. de C.V., d/b/a Aeromexico Connect, a flag carrier of Mexico, a Statement of Authorization permitting Aerolitoral to wet lease small aircraft, that is aircraft capable of carrying no more than 60 passengers, on a long term basis to Aerovias de Mexico, S.A. de C.V. for the provision of combination service over Aeromexico's authorized U.S.-Mexico transborder routes. The Statement of Authorization is set to expire on June 13, 2008. By Notice of Action Taken, dated December 12, 2007, in Docket OST-1997-2619, et aI., the Department removed the small aircraft condition on all of Aerolitoral's authority, including the wet lease at issue herein, for one year. Aerolitoral seeks renewal of the Statement of Authorization, as amended by the December 12, 2007 Notice of Action Taken, for an additional year. To the extent necessary, Aerolitoral also requests a waiver of the 45-day advance filing requirement. Aerolitoral will poll the U.S. carriers served with the application and report the results to the Department.

Aerolitoral and Aeromexico have negotiated a long term arrangement under which Aerolitoral will provide regional jet aircraft, with crew to Aeromexico for the operation of various services over Aeromexico's authorized Mexico-U.S. transborder routes, as requested by Aeromexico. The purpose ofthe wet lease arrangement is to afford Aeromexico the operating flexibility to respond to traffic fluctuations by utilizing regional aircraft or acombination of regional and large aircraft to serve markets on a more economic basis.
Aerolitoral will provide fully qualified and licensed crews and be responsible for maintenance ofthe aircraft. The aircraft will be under the exclusive possession. direction and operational control of Aerolitoral, and the Aerolitoral captain will have complete discretion concerning preparation and flight ofthe aircraft.
