Today the DOT denied ABSA’s request for a Statement of Authorization (#97-499, filed 8/6/97) to conduct a total of 26 roundtrip, Lima-Miami all-cargo charter flights, carrying asparagus, through 10/30/97, on behalf of five named charterers.

In reaching our decision in this case, we had unrebutted information from a U.S. carrier that the Government of Brazil had denied it the type of authority at issue here, namely, authority to conduct fifth-freedom charter operations. In light of this situation, we could not find that reciprocity on the part of Brazil was sufficient to make the public interest finding necessary under Part 212 to grant ABSA's request. Nor did ABSA persuasively demonstrate that there were any overriding public interest factors warranting approval of its request notwithstanding our reciprocity concerns.

We do not see our relationship with Brazil or Ecuador as a basis to withhold our approval, Grant of the authority here will enable AECA to conduct, through the wet-lease, U.S. operations that it could not conduct in its own right given that its homeland is an FAA Category II country. In the absence of evidence in the record of this carrier that either opposing U.S. carrier has suffered a denial of reciprocity on the part of either Brazil or Ecuador concerning analogous charter operations, we are, not inclined to prevent the continuation of the ongoing ABSA-AECA operation.
