Filed May 13, 2008 | Approved May 19, 2008 Application for Amendment and Renewal of Wet Lease Aerolitoral and Aeromexico have negotiated a long term arrangement under which Aerolitoral will provide regional jet aircraft, with crew to Aeromexico for the operation of various services over Aeromexico's authorized Mexico-U.S. transborder routes, as requested by Aeromexico. The purpose ofthe wet lease arrangement is to afford Aeromexico the operating flexibility to respond to traffic fluctuations by utilizing regional aircraft or acombination of regional and large aircraft to serve markets on a more economic basis. Aerolitoral will provide fully qualified and licensed crews and be responsible for maintenance ofthe aircraft. The aircraft will be under the exclusive possession. direction and operational control of Aerolitoral, and the Aerolitoral captain will have complete discretion concerning preparation and flight ofthe aircraft. Air Atlanta further requested authority, to the extent necessary, to revise future routings at the request of Lufthansa Cargo AG, subject to Lufthansa Cargo's DOT route authority. That application was granted on September 27, 2007 and the authorization granted remains effective through June 30, 2008. Air Atlanta is now requesting renewal of its existing authorization through December 31, 2008. AeroSvlt requires these operations by NEOS in order to carry out the AeroSvit fleet management and rotation schedules to and from the United States as well as third countries. AeroSvit holds U.S. exemption authority, initially Issued by Notice of Action Taken in Docket OST-2002-12356 on July 5, 2002 arid renewed on July 23, 2003. December 2, 2004 and December 15, 2005, to engage in scheduled foreign air transportation of persons, property and mall between points in Ukraine and the terminal point in New York, New York, as well as authority to conduct charters in accordance with Part 212 of the Department's rules. AeroSvlt's application for renewal of this authority was filed on November 30, 2006 and remains pending. By Notice of Action Taken on June 22, 2006 in Docket OST 2006-24835, NEOS holds exemption authority to operate between points in the Republic of Italy and points in the United States, as well as authority to operate between points in the United States and points In third countries subject to prior DOT approval. On February 28, 2008, while its 2006 permit application was pending, NEOS applied in Docket No. OST-2008-0075 for expedited exemption and a foreign air carrier permit for charter authority within the full scope authorized European charter carriers by the U.S.-European Union Air Transport Agreement.
