Commercial circumstances have changed considerably over the past several years, and British Airways' need to wet lease from Atlas has become ad hoc - with individual flights or flight programs of short duration from time to time in a variety of markets including, but not limited to, those covered by the above referenced authorizations. To reflect the new commercial reality, Atlas and British Airways have entered into a standby wet lease, pursuant to which Atlas will operate flights for British Airways on occasion as the need arises. Even though particular operations likely will be for less than 60 days, they all will be conducted pursuant to the standby wet lease, which has a term of more than 60 days. Because the individual flight programs thus may be deemed to be part of a long-term arrangement within the meaning of 14 C.F.R. §212.2, Atlas is applying herein for a statement of authorization.

Several years ago, the Department authorized Atlas to wet lease Boeing 747 freighter aircraft to British Airways for the operation of scheduled all-cargo service between London (Stansted) and Atlanta. See File No. 2000-19, approved September 13, 2000. It subsequently expanded the authorization to cover services between Manchester and London (Stansted), on the one hand, and Atlanta, on the other, nonstop and via Montreal on a blind-sector basis, and in the JFK-Stansted market. See File No. 2001-15, approved August 29, 2001, and File No. 2001-18, approved October 26, 2001.

Specifically, Lan Chile asks that its statement of authorization be amended, to the extent necessary, to enable Lan Chile to wet‑lease aircraft to Lan Ecuador for use in Lan Ecuador's proposed all‑cargo service between Quito and Guayaquil, Ecuador, on the one hand, and Los Angeles, on the other hand.

Simultaneously with the filing of this application, Lan Ecuador is filing an application to amend its exemption authority to permit Lan Ecuador to engage in scheduled all‑cargo service between Guayaquil and Quito, Ecuador, on the one hand, and Los Angeles, on the other hand. Lan Chile, therefore, requests an amendment of its statement of authorization, to the extent necessary, in order to wet‑lease aircraft to Lan Ecuador for use in Lan Ecuador's proposed allcargo service to Los Angeles.

Pursuant to its existing statement of authorization, Lan Chile wet-leases Boeing 767-300 aircraft to Lan Ecuador for service on the following routes: Guayaquil-New York (JFK); and Guayaquil-Quito-Miami.

The requested amended authorization will be in the public interest and is consistent with the U.S.‑Chile Open Skies Agreement. As a carrier from a country that has been placed in Category 2 under the FAA's TASA program, Lan Ecuador is not able to operate its own services to the United States. The wet‑lease arrangement with Lan Chile has allowed new service and new competition in the U.S.‑Ecuador market, all of which is consistent with the U. S.‑Ecuador Air Transport Agreement.
