United takes no position on the issue of whether such a blocked-space arrangement without a code share requires DOT approval. However, according to information available to U. S. government agencies, there are indications that Vietnam Airlines may, in the past, have sold seats under its own designator code on CAL flights to the U. S. That being the case, Vietnam Airlines presumably would like to resume such code-share/blocked-space service pursuant to DOT approval even though such approval is not being specifically requested in the instant application. In the interest of setting the stage for approval of an agreement on cooperative marketing arrangements such as third-country code shares, United believes that approval of the instant CAL application limited to interline blocked-space services (if approval for such services is deemed necessary) would be appropriate. Even if approval is not necessary, the Department should respond to CAL's application by noting that approval for a blocked-space agreement that involved code sharing would require approval and that such approval would be forthcoming under a regime that allowed reciprocal U.S. carrier code-share services.

United has urged the U. S. to seek approval by Venezuela of all pending U. S. carrier requests for code sharing that involve U. S. and thirdcountry carriers.' The joint request of Continental and Air Aruba for code-share authority to serve Venezuela should be deferred pending clarification of Venezuela's preparedness to approve all pending U.S./third-country carrier code-share services.
