VARIG, S.A., (Viaçao Aerea Rio-Grandense) ("VARIG") hereby applies for renewal of the special authorization first granted it by the Department in January, l995 to conduct transit flights in scheduled international air service operations between Brazil and Japan in conjunction with Japan Airlines. This application is being filed pursuant to Section 375.70 of the Department's regulations because Brazil is not a signatory to the International Air Services Transit Agreement and, therefore. cannot take advantage of the provisions of Section 375.50.  By its terms the grant of this authority is effective from February 21, 1997 through February 21, 1999. To the extent necessary, VARIG also request issuance of such other and additional authorizations as may be necessary for these operations, including Part 216 authorization for comingling of blind-sector traffic. Pursuant to Section 377.10 of the Department's regulations, VARIG hereby informs the Deparment that pending final DOT disposition of this renewal application, it intends to rely on the Administrative Procedure Act, 5 U.S.C. §558(c), as continuing in force the authority for these operations as granted by the Department in February 1997.
