Response of Fine Air
Fine Air is informed that, notwithstanding the February 28 Resolution, the Peruvian Government has not issued a new Permit to Export Air and the carrier's operations remain suspended. Attached hereto is a letter from Fine Air's Peruvian counsel, Dr. Elias Mendoza Habersperger, dated June 30, 1997. The letter states, inter alia: "We have confirmed today in the Direction [Directorate] of Air Transportation of the Ministry of Transportation that [it] has not announced any decision giving license of operations to Export Air, so that is still in force the disposition of suspension of operations."
The issue of whether Export Air lacks requisite Peruvian authority to conduct the proposed flights is clearly a question of fact that must be resolved before the instant application can even be considered record in this proceeding. But Fine Air does not believe that it is required to bear the burden of proof on this important issue. Indeed, it would seem entirely inappropriate for the Department to attempt to adjudicate competing claims by the parties in this proceeding regarding a matter as fundamental to the conduct of U. S. -Peru aviation relations as the qualifications of a Peruvian airline under Peruvian law. Given what must be seen at the very least as serious uncertainty as to the status of Export Air's homeland authority, the Department should simply seek a definitive statement of clarification directly from its counterpart agency in Peru

Scandinavian Airlines System and Air Canada

SAS and Air Canada intend to commence such code-sharing services on September 4, 1997, subject to the receipt of all necessary approvals. Under the carriers' code-share agreement the SAS code will be displayed on certain AC transborder flights, e.g., Seattle-Vancouver, Newark-Toronto, that will connect with SAS transatlantic flights at SAS's Newark and Seattle gateways. In addition, the AC code will be displayed on certain SAS U.S.-Scandinavia flights that connect with AC's transborder services, e.g., Newark-Copenhagen/ Oslo/Stockholm, Seattle-Copenhagen. All SAS and AC code-share passengers will have a Scandinavia-Canada routing such as Copenhagen-Newark-Toronto, none will originate in or be destined to the United States.
