We find that reciprocity with Italy, Air Europe's homeland, is sufficient to warrant approval of the request (we note, in particular, that no U.S. carrier served with the request answered that such reciprocity was not sufficient to grant the carrier's request here). We are not persuaded that denial of the request is justified in light of Laker's ability to perform the flights. We do not give U.S. carriers "first-refusal" privileges, and the fact that a U.S. carrier may state that it has operational capability to conduct a Fifth Freedom charter flight will not, in and of itself, cause us to deny a foreign carrier's application.

I refer to the application of Gemini Air Cargo of October 24, 1996, as amended on October 25, 1996, in which Gemini sought a Statement of Authorization for one year for a long-term wet lease to Asiana Airlines. On November 8, 1996, the Department granted the Statement of Authorization for 179 days, through May 5, 1996, and deferred action with respect to the remaining period of the requested authorization. Gemini hereby withdraws its application for a Statement of Authorization for the remaining period of the original application.
