On March 12, 1998, Radisson Seven Seas Cruises submitted a charter prospectus covering initially 18 flights over a four month period. We granted Air New Zealand's request for a statement authorization to the extent that it was consistent with the terms of that prospectus, and deferred action on the remainder of its application.

While Condor regrets any difficulty American may be having implementing its Mexican code-share services, it is unlikely that denial of Condor's extremely limited application would further American's objectives.
The Department recently acted to renew and approve third-country code-share agreements involving both Aeromexico (with Swissair) and Mexicana (with Aeroperu). Earlier this month, Mexicana received approval to place its designator code on Aeroperu flights operating between Los Angeles and Mexico City. Condor's request to place the MX code on its twice weekly Tampa-Mexico service is far more limited than the approval of third-country code-sharing in the competitive Los Angeles-Mexico City market. As the Department noted in its March 2, 1998, approval of the Mexicana/Aeroperu code-share, U.S.-Mexican aviation relations are "generally positive." As such, Condor should be treated no differently than Aeroperu and Swissair and receive the requested authority.
As the Hillsborough County Aviation Authority noted in its March 17, 1998, answer, Tampa currently receives no scheduled nonstop service to any point in Mexico. Given the absence of code-share provisions in the U.S.-Mexico bilateral agreement, the Department historically has used a public interest test to determine whether to authorize code-share requests. In this case, the introduction of Tampa's first nonstop services to Mexico clearly would further the public interest.

Amended Foreign Aircraft Permit
The foreign aircraft permit granted to Dassault Falcon Service on March 18, 1998, authorizing it under to conduct one passenger operation on behalf of Williams Grand Prix, over the routing Southampton, United Kingdom - Bangor, Maine (technical stop) - Akron/Canton, Ohio Manaus, Brazil (technical stop) - Rio de Janeiro, Brazil, during the period March 24-28, 1998, is amended to change the aircraft to be used to a French-registered Falcon 900, identification F-GLGY.

This is to inform you that the Part 375 application, which you approved for operation Kansai-Anchorage-Toronto, March 20-24 (#98-163) has been cancelled for technical reasons. I now enclose the original one copy of a new application for foreign aircraft permit pursuant to Part 375, which will cover the same operation identified in #98-163, rescheduled for operation March 29-31, 1998.
