Within the last several weeks, Andes has contracted to wet lease two Boeing 747 aircraft and one L-1011 aircraft, with a combined cargo capacity well in excess of a half million pounds. Hence, Andes overnight effectively has become one of the largest (based upon available wide-body freighter capacity) all-cargo operators in all of Latin America. That would be a truly remarkable endeavor - and corresponding financial commitment for any carrier, but it's an even more mind-boggling undertaking for a carrier that, according to the most recent issues of world Aviation Directory and Air Cargo Guide, only has one hundred employees and only operates three long-haul flights (i.e., three weekly U.S.-Ecuador frequencies).

If nothing else, this spate of recent wet lease activity raises fundamental questions as to where and how Andes intends to utilize such wet lease capacity, especially given the fact that it today does not operate any wide-body equipment and only serves one long haul market. Moreover, to the extent that this wet lease capacity is to be deployed in the U.S.-Ecuador market, it is unclear whether Andes has been allocated an appropriate level of frequencies by its own government to support such an operation. However, the applications currently on file with the Department do not provide these details.

United is not opposed in principle to the code share arrangement proposed by CAI and Lan Chile. United continues to object, however, to Canada's single-designation policy, which permits the code-share operations proposed by the applicants but prevents other carriers from offering viable competitive service in the Canada-U. S.-Latin America markets. United, for example, wishes to engage in the carriage of Canada-U. S. -Latin America code-share traffic with Air Canada, but is prevented from doing so because the Government of Canada continues to impose its protectionist single designation policy in these markets, shielding CAI and its alliance partners, such as Lan Chile, from competition.

Specifically, Northwest requests that the Department include the condition that United and Lufthansa give advance notice before beginning any new codeshare service. In their joint application dated January 26, 1998, United and Lufthansa indicated that they would comply with a condition requiring the carriers to notify the Department 30 days before they begin any code-share service in a new market not previously authorized, See Joint Application, p. 5. Any additional notification requirement is, therefore, unnecessary.
