Mexicana and Aeroperu respectfully request a statement of authorization to permit Mexicana and Aeroperu to engage in certain limited code-share operations on flights operated in the Mexico City-Los Angeles market. The carriers intend to commence code-share operations on January 15, 1998 and request that any approvals granted by the Department of Transportation remain in effect for a period of at least one year. The joint applicants request a waiver of the forty-five day waiting period so that the code-share services may begin without delay.

Continental, Continental Express and EVA Air (collectively, the "Joint Applicants") apply pursuant to Parts 207 and 212 of the Department's Regulations for: (1) a statement of authorization permitting Continental and Continental Express to display the EVA Air "BR*" designator code on Continental and Continental Express flights between: Honolulu and Houston, Los Angeles and San Francisco; Los Angeles and Cleveland, Houston, Newark, and San Francisco; Newark and Baltimore/Washington, Boston, Buffalo, Cleveland, Philadelphia, Pittsburgh, Richmond, Rochester (N.Y.), San Francisco, Syracuse, and Washington (DCA); San Francisco and Cleveland and Houston; and Seattle and Cleveland and Houston; and (2) a statement of authorization permitting EVA Air to display the Continental "CO" designator code on transpacific flights between Taipei and Honolulu, Los Angeles, Newark, San Francisco, and Seattle, and on flights between Los Angeles and Panama City. The Joint Applicants propose to implement their code-sharing agreement on March 29, 1998. The parties ask the Department to expedite its review of this application so they can begin promoting their cooperative services as soon as possible.
Continental and EVA Air have entered into an alliance agreement designed to expand the ability of each carrier to provide enhanced services to the traveling public. Under the agreement, transpacific flights operated by EVA Air between Taipei and Honolulu, Los Angeles, Newark, San Francisco and Seattle, and flights between Los Angeles and Panama City will display the "CO*" designator code and connecting Continental and Continental Express flights between those five U.S. gateways and the 11 other U.S. points identified above will display EVA Air's "BR*" code. Continental and EVA Air will price, market and sell their services independently, thereby expanding competition with each other on services between the U.S. and Taiwan. The parties will work together to align schedules, conduct joint promotional efforts, and develop a seamless transfer of passengers.
