Operating Limitations at Chicago O'Hare International Airport

August 13, 2004 Any long term solution should focus on increasing capacity at O'Hare instead of restricting schedules, particularly the schedules of a hub carrier such as American. American relies on O'Hare to support a major portion of its domestic and international route network, including service operated by American Eagle to smaller communities which are not being served by new entrant carriers. Reductions by American at O'Hare adversely affect numerous cities throughout the United States which depend on O'Hare for their access to the national air transportation system. August 13, 2004 As we stated at our meeting of 4 August, FedEx operates a handful of flight operations (four) during the congested hours of 0700-2100L. The majority of our flights occur during the less-congested late night/early morning hours. Our daytime operations, however, are critical to the economic well-being of the Greater Chicago Metropolitan Area because those operations bring large volumes of U.S. Mail into ORD, as well as FedEx shipments. FedEx does not have the option of reducing its limited operations during the congested hours, nor does it have the present capability of delaying those flights. Therefore, FedEx respectfully requests the FAA to recognize the importance of these operations, and continue to allow us the flexibility to operate during times which are necessary for the timely delivery of both U.S. Mail and FedEx products. In addition, depending upon market conditions, it may become necessary in the future to add additional flights to ORD. If the FAA ultimately adopts measures to restrict or cap arrivals into ORD, FedEx respectfully requests that air carriers which transport critical cargo and U.S. Mail shipments be afforded the maximum flexibility to arrive at times which facilitate the timely delivery of those shipments to individuals and businesses in the Chicago area. July 14, 2004 We anticipate that the Secretary of Transportation will soon determine, pursuant to 49 U.S.C. 41722, that it is necessary to convene a meeting of air carriers with the Administrator of the Federal Aviation Administration to discuss flight reductions at Chicago O’Hare International Airport in an effort to reduce overscheduling and flight delays during peak hours of operation. Because of severe congestion at that airport and the resulting delays and inconvenience to the traveling public, the Administrator intends to convene such a meeting in the immediate future. The purpose of this letter is to describe the format and procedures for the meeting and to ensure that, provided the meeting is conducted in accordance with this memorandum, the Department of Justice would not seek to challenge as a violation of the U.S. antitrust laws any air carrier’s attendance at or participation in the meeting or an air carrier’s actions taken to comply with an Order of the Administrator issued as a result of the meeting. July 19, 2004 Memorandum to the Administrator of The Federal Aviation Administration On July 16, you advised me of your determination under 49 U.S.C. 41722 that it is necessary to convene a meeting of air carriers with the Administrator to discuss flight reductions at Chicago O'Hare International Airport, which you find to be a severely congested airport, to reduce overscheduling and flight delays during peak hours of operation at that airport. Having reviewed your determination and the factual basis underlying your determination, and by the authority vested in me by 49 U.S.C. 41722, I hereby determine that such a meeting is necessary to meet a serious transportation need or achieve an important public benefit. August 11, 2004 Extension of Request for Information This action extends the period during which interested persons may submit written information, including data and views, in response to a notice that the FAA published on August 2, 2004. In that document, the FAA announced that it would hold a meeting beginning on August 4 to discuss flight reductions at Chicago’s O’Hare International Airport to reduce overscheduling and flight delays during peak hours of operation at that airport. In addition, the notice invited interested persons to submit written information on such schedule reductions. Since the meeting commenced on August 4, the FAA has continued discussions with air carriers that attended the meeting. The FAA is extending the period for filing written information to afford interested parties additional time to submit information while the discussions continue. DATES: Written information must be received on or before 1200 p.m. on August 13, 2004.
