Response of United Air Lines and Motion for Leave to File

United Air Lines, Inc. hereby responds to the March 1, 2004,"Comments" of AirTran Airways, Inc., in which AirTran reargues -- yet again -- its August 11, 2003 exemption application and subsequent Petition for Reconsideration (Dec. 4, 2003) seeking extraordinary relief from the Federal Aviation Administration's ("FAA") High Density Rule ("HDR") at New York's LaGuardia Airport ("LGA"), and amends its request for reconsideration from ten slots down to four slots (or slot exemptions) to operate one daily flight between LGA and Akron-Canton Airport and one daily flight between LGA and Newport News/Williamsburg with sound legal basis and precedent supporting its decision, the FAA denied AirTran's original application, concluding that AirTran's request could not lawfully be granted without opening the floodgate for all similarly situated carriers to request and be entitled to receive the same consideration. (Denial of Exemption No. 8139 (Oct. 3, 2003), at 6). The FAA should affirm its decision once again and deny AirTran's petitions.
