APPLICATION OF SOUTHERN AIR TRANSPORT, INC.
FOR RENEWAL OF SCHEDULED EXEMPTION AUTHORITY
Pursuant to the terms of 49 U.S.C. §40109, formerly §416(b)(1) of the Federal Aviation Act of 1958, as amended ("the Act"), and the Economic Regulations of the Department of Transportation ("DOT" or "the Department"), Southern Air Transport, Inc. ("Southern Air") hereby applies for renewal of its Exemption Authority from §401 of the Act authorizing Southern Air to provide foreign air transportation of property and mail on the scheduled all-cargo route: between a point or points in the United States, on the one hand, and the coterminal points Barranquilla, Bogota, Call and Cartagena, Colombia, on the other hand, via intermediate points.
In support of its application, Southern Air states as follows:
1. Southern Air has held authority to operate on the route described above since May 26, 1994. See Notice of Action Taken dated May 27, 1994. Most recently, by a
Notice of Action taken dated May 21, 1997, enclosed in Order 97-6-16, Southern Air's authority was renewed for one (1) year on this route. By an application which is currently pending in Docket 48658, Southern Air is seeking amendment of its §401 Certificate of Public Convenience and Necessity authorizing scheduled all-cargo service on this route. Since the Department has not yet acted upon Southern Air's §401 Certificate Amendment application seeking to conduct scheduled all-cargo service on this route, the scheduled exemption authority granted to Southern Air by the May 21, 1997 Notice of Action Taken will expire by its own terms on May 21, 1998. /12. Southern Air therefore requests that its authority to conduct scheduled all-cargo service between a point or points in the United States, on the one hand, and the coterminal points Barranquilla, Bogota, Call, and Cartagena, Colombia, on the other hand, via intermediate points be extended by a further year.
3. Southern Air continues to be fit, willing, and able to operate the schedule service referred to herein.
1/ Pursuant to 5 U.S.C. §558(c) as implemented in Part 377 of the Department's Regulations, Southern Air requests that the authority granted by the May 21, 1997 Notice of Action Taken, enclosed in Order 97-ó-16, as indicated above, remain in force until the disposition of this renewal application. Pursuant to 14 C.F.R. §377(10)(c), this Application is being filed at least sixty (60) days before the expiration of Southern Air's existing authority.
WHEREFORE, Southern Air Transport, Inc. respectfully requests that the Department renew its exemption authority to the extent necessary to enable it to continue to provide foreign air transportation of property and mail on the scheduled all-cargo route: a point or points in the United States, on the one hand, and the coterminal points Barranaquilla, Bogota, Call, and Cartagena, Colombia, on the other hand, via intermediate points. In the alternative. Southern Air requests such other, further, or different relief as the Department may deem appropriate.
