Thai Airways International Public Company Ltd. and Lufthansa German Airlines hereby submit this joint application that seeks: (1) renewal of exemption authority and a joint statement of authorization previously issued by the Department enabling Thai and Lufthansa to code share between Thailand and four points in the United States (Atlanta, Dallas, Miami and New York) via Frankfurt, Germany; and (2) expansion of the existing authorities to add two new U.S. code share points, (Chicago and Washington), and a new intermediate point (Munich, Germany). Specifically, the parties apply as follows: Thai applies for renewal of an exemption issued on December 29, 1998 and expiring on December 29, 2000, enabling Thai to offer scheduled combination service between points in Thailand, on the one hand, and Atlanta, Dallas, Miami and New York, on the other hand, via Frankfurt (without local Frankfurt-U.S. traffic rights) on a code share basis with Lufthansa.

• Lufthansa and Thai apply for renewal of a joint statement of authorization issued on December 29, 1998, and expiring on December 29, 2000, permitting (i) Lufthansa to carry Thai's code on Lufthansa's services between Frankfurt, on the one hand, and Atlanta, Dallas, Miami, and New York, on the other hand, and (ii) Thai to carry Lufthansa's code on Thai's Frankfurt-Bangkok/Phuket service.

• Thai applies to amend the afore described exemption to add Chicago and Washington as U.S. points to be served on a code share basis with Lufthansa, and to add Munich as an intermediate point (again, without local Munich-U.S. traffic rights).

• Lufthansa and Thai apply to amend the joint statement of authorization to permit (i) Lufthansa to carry Thai's code on Lufthansa's services to/from Chicago and Washington (in addition to Atlanta, Dallas, Miami and New York), and on Lufthansa services between those six points and Munich (in addition to Frankfurt), and (ii) Thai to carry Lufthansa's code on Thai's Munich-Bangkok flights.

Thai Airways (Thai) requests (1) renewal of its exemption from 49 U.S.C. 41301 to conduct scheduled foreign air transportation of persons, property and mail between Thailand and Atlanta. GA; Dallas, TX, Miami, FL; and New York, NY; via Frankfurt, Germany (without local Frankfurt-U.S. traffic rights) on a code-share basis; and (2) Amend to add Chicago, IL, and Washington, DC, as U.S. code-share points, and to add Munich as an inter-mediate point (without local Munich-U.S. traffic rights). --Lufthansa and Thai request (1) renewal of joint statement of authorization pursuant to 14 CFR 212 of the Department's regulations to display Thai's airline designator code on flights operated by Lufthansa between Frankfurt and Atlanta/Dallas/Miami/New York; and to display Lufthansa's code on flights operated by Thai between Frankfurt and Bangkok/Phuket; and (2) Amend to display Thai's airline designator code on Lufthansa flights to/from Chicago/Washington, DC; and between Atlanta/Dallas/Miami/New York/Chicago/Washington, DC, and Frankfurt/Munich; and to display Lufthansa's code on Thai flights between Munich and Bangkok.
