Application for Renewal of Exemptions
The route authority renewals requested herein are also the subject of permanent route authority currently being sought by THAI by means of an amendment to THAI's permit. A petition seeking that amendment was filed before the Department on March 21, 1997, and is currently pending. Should that permit amendment be approved by the Department prior to consideration of this petition, this petition would become moot. However, the Department has indicated that the timing of Departmental action on the request for a permit amendment cannot be predicted, and that it is quite possible it will not be acted upon for a period of time that would exceed the expiration dates for the exemptions here at issue. Therefore, THAI has been advised by the Department to proceed with the instant request for a renewal of exemptions.

Application for Amendment of Exemption
THAI notes that although the current application would not eliminate THAI's current authority to operate combination services between Bangkok and Los Angeles over Seoul, nonetheless in practice it intends to suspend operations on that route and replace them with the BKK-LAX combination services sought over Osaka. Therefore, it notes that THAI does not intend to fly any net additional flights between Los Angeles and Bangkok. Rather, the intention is to fly the same frequencies each week as currently, except all would be intended to fly over the same intermediate point and to originate and terminate at identical times each day of the week. Travelers are known to value predictability and regularity in service offerings, and therefore THAI believes this change will be of benefit to travellers.

Applies for renewal of its exemption from the requirements of 49 U.S.C. §41301 authorizing Thai to serve Seoul, Korea and Osaka, Japan as intermediate points on its Bangkok-Los Angeles scheduled services. Thai also asks that the exemption as currently drafted be amended to replace the route-specific frequency restrictions with a single restriction, applicable to all routes, that more accurately reflects the frequency conditions contained in the 1996 U.S.-Thai bilateral agreement. Thai is not currently conducting combination services via Seoul or all-cargo services via Osaka, it has done so in the past and may seek to do so again, and therefore asks that these portions of its exemption authority also be renewed. Thai is operating daily service over a Bangkok-Osaka-Los Angeles routing. Starting March 28, 1999, Thai will change its schedule: it will operate flights three times per week over a Bangkok-Osaka-Los Angeles routing, and four times per week over a Bangkok-Tokyo-Los Angeles routing.

Pursuant to the above described authority, during the past year, Thai has operated combination services between Bangkok and Los Angeles via Osaka. Thai wishes to continue offering such services and, accordingly, hereby requests renewal of its exemption authority to conduct scheduled combination services via Osaka. Although Thai is not currently conducting combination services via Seoul or all-cargo services via Osaka, it has done so in the past and may seek to do so again, and therefore asks that these portions of its exemption authority also be renewed.
Specifically, Thai's permit states: Thai Airways is authorized to engage in scheduled foreign air transportation of persons, property and mail between the terminal point Bangkok, Thailand via the intermediate points Tokyo, Japan and Seattle,Washington, and the coterminal point Los Angeles, California and one additional point in the United States .

These flights expand the service options available for travelers and shippers, and contribute to tourism and trade in the region. Thai's services have been well-received by U.S. and Thai passengers and shippers, and the flights enhance competition in the U.S.-Thailand and U.S.-Japan markets. Renewal of the exemption, therefore, will serve the public interest.
