Continental does not oppose the joint application of Delta and CSA for a blanket statement of authorization for broad U.S.-Czech Republic-beyond codeshare authority so long as the Department applies its standard condition requiring the Joint Applicants to provide notification before instituting third-country codeshare service, invites competing applications for limited-entry routes, and institutes competitive carrier-selection procedures to determine which carriers should be authorized to provide codeshare service on limited-entry routes such as the France routes where Delta and CSA propose to codeshare.

To date, the United/Austrian/Lauda/Tyrolean applications remain pending before the Department. United hereby objects to Delta's application to code share with CSA unless United's pending applications to code share with Austrian, Lauda, and Tyrolean are approved no later than Delta's. To do otherwise would test the bounds of fairness since United's applications, which have been pending with the Department for three months, are non-controversial and uncontested. There appears to be no reason why the Department should not immediately approve United's applications.

The extraneous issues raised by United, pertaining to the FAA's safety oversight program, and the flatly incorrect assertions of Continental relating to Delta's alleged "unwillingness" to accept the Department's standard blanket codeshare conditions, provide no reason to delay expeditious approval of the Joint Application.

If no competing applications are received, the available designation should be awarded to Delta in order to provide the traveling public with beneficial new service options between the United States and France. Delta is fully prepared to put the available U.S.-France designation to productive use in conjunction with its alliance partner, CSA. Delta and CSA would propose to implement additional service to Lyon and Paris, France, via Prague, effective April 1, 2001. However, if viable competing applications are filed, Delta is willing to recede its request in favor of another applicant.

Delta further urges the Department to immediately approve the remainder of the Joint Application, which is non-controversial and plainly authorized under the U.S.-Czech open skies agreement. As noted in the Application, the Joint Applicants plan to commence reciprocal codeshare service at the start of the Summer 2001 traffic season on March 25, 2001. The Joint Applicants timely filed their application on October 27, 2000 and have also submitted the required audit review statement to the FAA. Any further delay in the processing of this routine codeshare request will cause the Joint Applicants unwarranted commercial harm.

Delta and CSA propose to commence CSA codeshare service from New York (JFK) to six additional U.S. cities served by ASA and Comair. The operating carriers for the specific proposed routes are set forth in Exhibit A of this application. Delta and CSA plan to begin operations utilizing Delta Connection services on or about April 9, 2001. Accordingly, the Joint Applicants request that this amendment to the previously issued blanket statement of authorization be granted as expeditiously as possible. Effective June 15, 2002, CSA plans to display its "OK" designator code on flights operated by Comair between New York (JFK) and Philadelphia (PHL).  In addition, Delta hereby notifies the Department that notice given for a service point by Delta or either of its connection carrier affiliates, ASA and Comair, should be deemed notice given for all three carriers. This will assist Delta in maintaining the most efficient allocation of flying between mainline and connection carriers, without undue administrative burdens. The Department has previously granted Delta and other carriers similar flexibility. See, e.g., Department Action on Delta/SAA/Comair Application in Docket OST-99-6556 (August 27, 2001).

Similarly, Delta and CSA notify the Department that notice given for any domestic U.S. or beyond service point should be deemed notice for service via any or all of Delta's and CSA's authorized U.S. transatlantic gateways. The Department has allowed similar flexibility to blanket statement of authorization holders from other open skies countries. See, e.g., Delta/ASA/Comair/Alitalia, Docket OST-2001-10417.
