This exemption application is submitted in conjunction with the Joint Application of United, Lauda Air and Tyrolean for Statements of Authorization filed on August 7, 2000 in Docket OST-00-775 1. In that Joint Application, among other requests for authority, United and Tyrolean request authority to engage in code-sharing services under which Tyrolean will display United's "UA" designator code on flights operated by Tyrolean: (1) between points in Austria in conjunction with services held out by United between the U.S. and Austria, and (2) between any point in Austria and any point in a third country.

OST-00-7838 March 12, 2003 Application for Renewal of Exemption Austria - Points in Third Countries

The Department granted Tyrolean's exemption authority in conjunction with a code-sharing statement of authorization whereby Tyrolean displays United's "UA" designator code on flights operated by Tyrolean between points within Austria and between points in Austria and points in third countries. See Department Action on Application in Docket OST-2000-7751, dated March 22, 2001. Although the code-sharing statement of authorization was approved indefinitely, Tyrolean requires renewal of its exemption authority to continue to offer code-sharing services with United on its scheduled flights within and beyond Austria.

With the exception of Austrian Airlines' acquisition of a 100 percent interest in Tyrolean, and certain other relatively minor changes in Tyrolean's financial statements, intra-Europe operations and aircraft fleet, the information filed by Tyrolean in Docket OST-97-2972 remains essentially unchanged. Tyrolean hereby adopts that information by reference in support of its renewal application in this proceeding.  Tyrolean will continue to comply with the conditions of the code­share authority granted in Docket OST-2000-7751, and with the applicable provisions of Order 2001-1-19 granting approval and antitrust immunity for certain alliance agreements.

Re: Application for Renewal of Exemption (Change in Corporate Status)

Tyrolean Airways, Tiroler Luftfahrt AG has changed its corporate status from Aktiengesellschaft ("AG") (that is, a general stock corporation) to Gesellschaft mit beschränkter Haftung ("GmbH") (that is, a limited liability company). Accordingly, the company's name is now "Tyrolean Airways, Tiroler Luftfahrt GmbH". This change in corporate status does dot affect the ownership or control of the company. Tyrolean hereby requests, to the extent necessary, that the DOT exemption and other authority issued to Tyrolean reflect this name change.

In addition to the exemption authority in the above-referenced docket, Tyrolean holds a codesharing statement of authorization in Docket OST-2000-7751. Tyrolean is also an "affiliate" covered by the Department's Orders granting approval of and antitrust immunity for alliance agreements in Docket OST-2000-7828 and OST-2001-11029.

Re: Registration of Trade Name

Tyrolean Airways, Tiroler Luftfahrt GmbH an airline of Austria that holds exemption authority in the above‑referenced Docket, intends to do business as "Austrian arrows," and hereby submits this statement requesting registration of such trade name pursuant to 14 C.F.R. Part 215.

Tyrolean is a member of the Austrian Airlines Group that specializes in regional air service. Tyrolean does not provide air transportation to the United States, but holds DOT authority for the sole purpose of displaying the designator code of United Air Lines, Inc. on flights operated by Tyrolean within and beyond Austria. Accordingly, the use of the "Austrian arrows" trade name does not raise any public confusion concerns or other issues requiring DOT resolution, and this registration should be promptly acknowledged by the Department under section 215.6.

In addition to the exemption authority in the above-referenced docket, Tyrolean holds a codesharing statement of authorization in Docket OST-2000-7751 Tyrolean is also an "affiliate" covered by the Department's Orders granting approval of and antitrust immunity for alliance agreements in Docket OST-2000-7828 and OST-2001-11029.
