Application of Apoyo Aereo, S.A. DE C.V. pursuant to 9 USC Section 40109 and Subpart D of the Department's Procedural Regulations, requests an exemption from 49 USC Section 41301 to authorize Apoyo Aereo, S.A. DE C.V. to engage in foreign charter air transportation of persons, with small aircraft between
Mexico and the United States and, subject to prior approval, between other countries and the United States. As more fully described herein, Apoyo Aereo, S.A. De C.V. also requests limited stopover privilege and relief from the requirements to obtain advance approval for each Mexico-US. flight. Apoyo Aereo, S.A. De C.V. requests that this exemption be granted for a period of at least one year.

APOYO hereby applies for renewal of its exemption from 49 U.S.C. 40301 which authorizes APOYO to engage in charter foreign air transportation of persons and their accompanying baggage with small aircraft between the United States and Mexico, and, subject to prior Department approval between other countries and the United States. APOYO also requests renewal of its relief from the requirement to obtain advance approval for each Mexico-U.S. flight and stopover privileges. The Department granted the above authority to APOYO by Notice of Action Taken dated September 15, 2005. APOYO requests that this authority, which is scheduled to expire on September 15, 2006, be renewed for a period of at least one year.

We note that Taxi Aereo de Veracruz, S.A. de C.V. did not request stopover privileges or relief from the requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States. We have decided to grant the applicant that authority.

Taxi Aereo de Veracruz, S.A. de C.V., Aero Quimmco, S.A. de C.V., Servicios Especiales del Pacifico Jalisco, S.A. de C.V., and Aero Empresa Mexicana, S.A. each requested that their authority be granted for a two-year term. As to the other applicants, we have decided, on our own initiative and in the interest of administrative efficiency, to grant the exemption authority for a two-year term.
