Air France and Comair intend to begin marketing and sale of their proposed code-sharing services as soon as possible, with the first code-share flights operated on March 26, 2000, subject to the receipt of a necessary approvals. Comair and Air France also request that the Department grant the statement of authorization requested for an indefinite period as soon as possible.  Air France and Delta, for whom Comair is a Delta Connection partner, have been codesharing on each other's U.S.-France flights since May 1998, including Delta's Cincinnati-Paris nonstop flight. Air France plans to introduce its own Cincinnati-Paris nonstop flight in connection with its Summer 2000 schedules on May 15, 2000. As Comair is Delta's Delta Connection partner based in Cincinnati and operates a major hub with regional aircraft out of Cincinnati, Air France desires to place its "AF" code on the Delta Connection flights operated by Comair between Cincinnati and numerous U.S. cities. Currently Comair operates Delta Connection flights to approximately 86 U.S. cities from Cincinnati, many with regional jets. All Air France code-share passengers will have a U.S.-France or beyond (or a Canada-France) routing that will include carriage on the Air France Cincinnati-Paris flights operated either by Air France or Delta.

The carriers wish to notify the Department that Air France is now operating this flight with an intermediate stop in Bangui, Central African Republic (BGF) on the return leg of the flight between N'djamena and Paris. By this Application, Brit Air and Delta seeks amended exemption and codeshare authority so that Brit Air can display the "DL" code on any additional intra-Europe city-pairs operated by Brit Air for Air France, subject to the filing of a 30-day advance notice for each new city-pair. In other words, the Joint Applicants seek a blanket statement of authorization (and related exemption authority) so that Brit Air can display the "DL" code on any of its intra-European flights, similar to the blanket statements of authorization granted Air France and Delta (See Statement of Authorization #98-303).

In addition, the Joint Applicants request consolidation of the Brit Air Application docket into Docket OST-2000-6939, the consolidated docket established by the Department for the administration of the blanket codeshare statements of authorization held by Delta, Air France, and Delta's connection carriers, Atlantic Southeast Airlines, Inc. and Comair, Inc. This will allow "Air France Partner" carriers such as Brit Air to receive treatment similar to the treatment accorded to Delta and its Delta connection carriers for purposes of codeshare authorizations. Specifically, a codesharing notice given for Air France or Brit Air should be deemed as notice given for either carrier, thus allowing Brit Air to display the "DL" code on intra-European city-pairs authorized already for Delta codeshanng on Air France, and vice versa.

Regional is a French regional carrier wholly-owned (100%) by Air France that operates as an "Air France Partner" carrier, and now seeks to engage in codeshare operations with Delta on certain Paris-intra European segments connecting with Delta international services.  As relevant to this Application, Regional acts as a regional feeder carrier for Air France at Pans (CDG). Additionally, Regional operates its own flights throughout Europe, serving some 47 points with a fleet consisting of 63 turboprop and regional jet aircraft. Delta and Air France hereby notify the Department that Air France plans to display its "AF" designator code on flights operated by Delta and Delta Connection carriers between Air France's authorized U.S. gateways and the following points: Manchester, N.H. (MHT) and Kalului, Hawaii (OGG). Air France wishes to begin offering the new codeshare services as soon as possible on or after June 1, 2003. Accordingly, if the DOT and FAA are able to complete their internal review processes in advance of the normal 30 day waiting period, Air France and Delta request permission for early implementation. However, Air France will not implement service until the earlier of 30 days from the date of this Notice or confirmation of the Department's concurrence with this request.

Decision Approving the Application

By Statements of Authorization issued August 6, 1998, March 3, 2000, and February 26, 2002, Delta, Atlantic Southeast, and Comair were granted blanket authority to code share with Societe Air France subject to the condition that they notify the Department no later than 30 days before they begin any new code-share service under the code-share services authorized. The carriers have requested a waiver of this requirement to enable them to begin service immediately upon confirmation by the Department. There were no answers to the requested waiver. Under these circumstances, we find it in the public interest to grant the requested waiver.

Delta plans to display its "DL" designator code on flights operated by Air France and its subsidiaries between Nice (NCE) and the following points in France: Bordeaux (BOD) Clermont-Ferrand (CFE) Lyon (LYS) Muihouse (MLH) Nantes (NTE) Rennes (RNS) Strasbourg (SXB).

Delta and Air France have relied on services via Paris (CDG) to provide beyond/behind codesharing to destinations in Europe and beyond. By this notice, the carriers hereby advise the Department of their intent to utilize the Nice gateway to provide alternative codeshare routings to authorized service points (or to add new points to their codeshare network subject to the 30 day notice condition). Delta presently operates its own aircraft between New York and Nice, and each of the named service points is already covered by a 30 day advance codeshare notification.

Comments of American Airlines

Under the U.S.-Spain Air Transport Agreement, as amended, codesharing is authorized to only four cities in Spain: Madrid, Barcelona, Malaga, and Palma de Mallorca. See American/Iberia codeshare approval, Notice of Action Taken, undocketed, August 6, 1998. Accordingly, the Delta/Air France Notice of codesharing to Bilbao and Vigo is not technically valid, and should be treated by the Department as a proposal to codeshare extra-bilaterally.

On March 22, 2007, the Council of European Transport Ministers unanimously ratified an historic open skies agreement between the U.S. and the EU, which is scheduled to take full effect on March 30, 2008, the beginning of the Summer 2008 traffic season.

If the Department is prepared to allow extrabilateral codesharing by Delta/Air France to points in Spain, American and Iberia would want to apply for such rights as well. Spain supported U.S.-EU open skies, and it would be in the public interest to allow carriers in the U.S.-Spain market to benefit from the spirit of U.S.-EU open skies in advance of the effective date.

Accordingly, American does not object to the Delta/Air France proposal, so long as American and Iberia are permitted to engage in extra-bilateral codesharing and an application to do so is granted on an expedited basis.

Re: Joint Applicants Cannot Proceed with Additional Codesharing

We are in receipt of the March 12, 2007, 30-day notice submitted on behalf of Delta Air Lines, Inc. and Societe Air France, and their affiliates notifying the Department of their intention to display Delta's "DL" code on flights operated by Air France and/or its affiliates on flights between Paris, France and Bilbao and Vigo, Spain. Unfortunately, the current U.S-Spain aviation agreement does not name Bilbao and Vigo as points in Spain that U.S. carriers may serve. As a result, we hereby put the Joint Applicants on notice that they cannot proceed with their plans as reflected in the March 12 notice.

We note that the European Community Council of Transport Ministers has approved the first phase United States-European Union Air Transport Agreement, which will establish open skies between the United States and all 27 EU member states. When an open-skies relationship is being applied between the United States and Spain, carriers will no longer be limited in terms of named points. At this time, however, please be advised that the Department is not prepared to approve the proposed services.

Delta/Air France previously provided notice with respect to all of these beyond-gateway points via the Paris gateway. By Notice dated September 2, 2003. the carriers added beyond-gateway service to existing and future codesharing points via the Nice gateway. The Department routinely permits U.S. carriers to exercise such flexibility in operating beyond/behind-gateway codeshare flights via multiple transatlantic gateways within the homeland country of open-skies codesharing partners. See. e.g., Docket OST-2001-10417 (authorizing Delta/Alitalia services between the Rome/MilaniVenice gateways and multiple points in Italy and third countries).
