As initially granted by Notice of Action Taken in this docket on March 23, 2000, the exemption authorized service via the intermediate point Zurich, and American used such authority for codesharing service with Swissair.  American requests that the exemption be amended to authorize service via intermediate points, rather than the specific point Zurich, and that the authority include route integration rights with American's other certificate and exemption authority. American  intends to use the amended authority for codesharing service with British Airways, via London, pursuant to the American/ British Airways blanket codesharing application submitted on August 10, 2001 in OST-2001-10388.

By its application dated January 18, 2002, American requests renewal and amendment of its exemption authority to serve Austria and the Czech Republic. Delta has no objection, in principle, to American's exemption request, including the additional flexibility American seeks to offer codeshare service to those countries via open intermediate points, since that request is fully consistent with the open skies agreements in place with Austria and the Czech Republic. Delta does, however, strongly object to American's purported intent to "use the amended authority for codesharing service with British Airways, via London, pursuant to the American/British Airways blanket codesharing application submitted on August 10, 2001 in OST-2001-10388. That application is highly controverted and is currently the subject of a Motion to Dismiss, precipitated by American's and British Airway's rejection of the Department's remedial conditions that would have permitted such joint AA/BA codeshare, marketing and other commercial arrangements.

In this proceeding, American is seeking renewal and amendment of its exemption authority to serve between U.S. points, on the one hand, and Austria and the Czech Republic, on the other hand. As initially granted, the authority specified the intermediate point Zurich. American now requests authority via any intermediate point, consistent with the open skies agreements the U.S. has with both Austria and the Czech Repub­lic. In its application, American stated an intention to use the requested authority for a codesharing arrangement with British Airways. Delta argues that the exemption should not be granted because codesharing between American and BA has not been approved. But this docket is not the place to address that issue. Under the open skies agreements with Austria and the Czech Republic, U.S. carriers are entitled to hold authori­ty to serve between the U.S. and those two countries, via intermediate points.  That is the authority American is seeking in this docket. Delta's agenda against AA/BA is irrelevant here.
