OST-2007-28724 - Commuter Air Carrier Authority Apri 9, 2007 Application for Commuter Authority Applicant requests authority to engage in scheduled passenger operations as a commuter and proposes to operate interisland service in the State of Hawaii. Porposed service will link the outer islands to the main islands of Ohau, Maui and the big island of Hawaii. Air Molokai Nui, Inc. will operate Piper Navajo Chieftain aircraft having a seating configuration of 9 passengers or less and a payload of less than 7500 pounds. Applicant is currently engaged in on demand operation with FAA authority to conduct operations in the 48 states and Hawaii. We have also attached revised projections for November and December. Per DOT request we have also provided a "going projection" for our expectations beginning in January 2008 and a 12 month projection based on the going month. These projections include detailed information on both our cost structure and our overall profit and cash flow structure. Specifically, I request that my personal account information enclosed be kept confidential. At a minimum, I strongly request that the name and account number information contained within the enclosed statement be withheld or obscured from public disclosure. Order 2008-3-26 Issued and Served March 26, 2008 Order to Show Cause Proposing Issuance of Commuter Air Carrier Authority We tentatively conclude that AMN is a U.S. citizen and is fit, willing, and able to provide scheduled passenger operations as a commuter air carrier, subject to conditions. However, we will give interested persons an opportunity to show cause why we should not adopt as final these tentative findings and conclusions. AMN, air taxi operator, was incorporated in the State of Nevada on June 24, 2005. It currently holds a Federal Aviation Regulations Part 135 certificate from the FAA and operates on-demand charter service under 14 CFR Part 298 of the Department's regulations, between Molokai and Honolulu, Hawaii, using two PA-31-350 aircraft (PA-31). We will give interested persons 14 days following the service date of this order to show cause why the tentative findings and conclusions set forth here should not be made final; answers to objections will be due within 7 days thereafter. We expect such persons to direct their objections, if any, to the application and points at issue and to support such objections with detailed economic analyses. By: Michael Reynolds
Order 2008-4-19 Issued and Served April 10, 2008 By Order 2008-3-26, issued March 26, 2008, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions that Air Molokai Nui, Inc., is a citizen of the United States and is fit, willing, and able to engage in scheduled passenger operations as a commuter air carrier, subject to conditions. OST-2007-28724 - Commuter Air Carrier Authority - Hawaii January 12, 2009 Re: DOT Letter Requesting Additional Information As you know, by Order 2008-4-19, issued April 10, 2008, the Department found Air Molokai Nui, Inc. fit, willing, and able to engage in scheduled passenger operations as a commuter air carrier. The effectiveness of this authority was conditioned upon AMN's fulfilling a number of conditions, including providing us with a copy of its Air Carrier Certificate and Operations Specifications from the Federal Aviation Administration authorizing such operations. Although over nine months have elapsed since the Department granted commuter authority to AMN, to date, the company has not fulfilled the conditions imposed by Order 2008-4-19 to have its authority made effective. This letter is to remind AMN of the requirements of section 204.7 of the Department's regulations and the impact of that section on its authority. Specifically, section 204.7 provides, among other things, that the authority granted to a company shall be revoked if the company does not commence actual flying operations under that authority within one year of the date of the Department's determination of its fitness, that is, by April 10, 2009. OST-2007-28724 - Commuter Air Carrier Authority - Hawaii February 9, 2009 Re: DOT Revoking Commuter Authority We have been notified by the Federal Aviation Administration that Air Molokai Nui, Inc. voluntarily surrendered its Air Carrier Operating certificate on or about July 17, 2008, and no longer has Federal Aviation Regulations Part 135 certificate authority from the FAA to provide on-demand operations. It appears that AMN does not intend to commence operations; therefore, we propose to revoke its commuter air carrier authorization without waiting for the dormancy period to expire on April 10, 2009. The Department's decision to revoke AMN's commuter authority immediately is based upon our evaluation of AMN not being in a position to fulfill the conditions set forth by Order 2008-4-19, and to make its authority effective by April 10, 2009. We ask that AMN advise the Department within 30 days of the date of this letter if it objects to the immediate revocation of its economic authority. If we do not hear from AMN within this time, we will assume that it does not object to the Department's decision to immediately revoke its authority without further notice. Order 2009-4-11 Issued and Served April 22, 2009 Order Canceling Commuter Authority By this order, we cancel the Commuter Air Carrier Authorization issued to Air Molokai Nui, Inc. for reason of dormancy. By letter dated January 12, 2009, the Department advised AMN that, pursuant to section 204.7, its commuter authority would be revoked for reason of dormancy if it had not commenced operations by April 10, 2009. Subsequently, the Federal Aviation Administration informed the Department that AMN voluntarily surrendered its Air Carrier Operating Certificate on July 17, 2008, and no longer had Federal Aviation Regulations Part 135 certificate authority. By letter dated February 9, 2009, the Department notified AMN that we proposed to cancel its commuter authority before expiration of the one year dormancy period since it had surrendered its FAA certificate. To date, we have not received a response from AMN. Under these circumstances, and in accordance with section 204.7 of our rules, we cancel the Commuter Air Carrier Authorization issued to AMN.
