Air-India will offer India-San Francisco service operated via Singapore. Under its codeshare agreement with Singapore Airlines, Air-India will purchase and sell in its own name a limited number of seats on Singapore Airlines' flights operating between San Francisco, California, and Singapore. These flights will connect in Singapore with Air-India's flights operating to various points in India. Air-India will not use its own aircraft or crews to operate any of the San Francisco-Singapore flights, and does not plan to offer fifth freedom San Francisco-Singapore service. Rather, Air-India's service will be limited to transporting passengers between India and San Francisco via Singapore. Codeshare service will begin on May 1, 2003.
The Department has previously determined that similar codeshare services operated by Air-India in conjunction with Singapore Airlines as well as Malaysia Airlines are consistent with the 1995 MOC. See Notice of Action Taken dated March 28, 2001, in Docket OST-2001-8976 approving codesharing with Malaysia Airlines ("The codeshare services proposed are fully consistent with the 1995 U.S.-India MOC."); Notice of Action Taken dated February 9, 2001, in Docket OST-98-3549 approving codesharing with Singapore Airlines via Singapore and Taipei.

As a result of the level of operations since early January, two Brazil frequencies not covered by the existing dormancy waiver may become subject to loss as soon as early April. An additional frequency may become subject to loss in late May or early June. With continuing adverse economic conditions and strong demand for Atlas aircraft to support the U.S. military, Atlas will not soon be in a position to resume regular use of these three frequencies. Moreover, the need to support the military, rapidly growing global tensions and the continuing economic downturn combine to make it highly unlikely that Atlas will be in a position to meet the current May 9 deadline to start operating the two Brazil flights for which it already holds a dormancy waiver.

We are denying Sabre's petition for a "fact hearing" that would give each commenter the opportunity to interrogate Department staff members about the basis for the notice of proposed rulemaking's tentative findings and proposals and to cross-examine representatives from the other commenters. Such a hearing would be neither necessary nor useful. Our notice discussed in detail the basis for our proposals, and we have given the public the opportunity to file both comments and reply comments, which will enable them to present their evidence and arguments on the issues.
We agree with several of the commenters that a hearing where they can present their factual and legal arguments may be useful. We therefore plan to hold such a hearing between the end of the comment period, March 16, and the end of the reply comment period, May 15.By: Thomas Ray, 202-366-4731
