By this exemption request, Aeromexico seeks to renew its exemption authority to engage in scheduled foreign air transportation of persons, property and mail between Leon and San Jose del Cabo, on the one hand, and Atlanta, on the other. The exemption authority was granted by Notice of Action Taken, dated March 28, 2002, and will expire on March 28, 2003.
Aeromexico currently is offering daily nonstop service between San Jose del Cabo and Atlanta by placing it two letter designator code on flights operated by Delta Air Lines, Inc., between these points. Passengers have benefited from the competitive service in the market and Aeromexico wants to continue to provide this service. Aeromexico currently is not serving the Leon-Atlanta route but it hopes to resume service when traffic conditions warrant; thus, it seeks renewal of that authority.Counsel: Piper Rudnick, William Evans, 202-371-6030

Exemption authority from 49 U.S.C. § 41301 to engage in charter foreign air transportation of property and mail between any point or points in the Bahamas and any point or points in Florida; and other all-cargo charter operations subject to Part 212 of the Department’s rules. Cherokee Air holds a foreign air carrier permit, issued by Order 2002-6-4, which authorizes it to engage in charter foreign air transportation of persons, property and mail between any point or points in the Bahamas and any point or points in Florida, but limited to operations involving small aircraft (i.e., aircraft designed to have a maximum passenger capacity of not more than 60 seats or a maximum payload capacity of not more than 18,000 pounds).

It is common industry knowledge that CRS companies enjoy large profit margins while many of their suppliers of information (the airlines) suffer big losses or have deteriorating margins. This is due in part to the rules that govern the CRS industry. It is also no secret that CRS companies provide incentives to their travel agent subscribers for business volume, distorting competition. CRS fund such incentives by increasing the booking charges they levy on airlines. Without viable alternatives of distribution to the CRS for many years, airlines have no real alternatives.
This position paper sets out the views of Singapore Airlines on the rules proposed by the Department of Transportation governing airline reservation systems. The paper addresses the fundamental principles of creating undistorted competition in the CRS business, decreasing airline distribution cost to benefit consumers’ interests, and promoting the development of alternative distribution channels.

Interested persons were given 14 calendar days to file objections to the order.

We represent Jazz Air Inc. d/b/a Air Canada Jazz, which is the successor foreign air carrier resulting from a series of consolidations among several regional Canadian carriers. Some of these former carriers held foreign air carrier permits under 49 U.S.C. § 41301. In particular, the Department issued foreign air carrier permits, in Order 98-5-11 (Dockets OST-1995-266 and OST-1995-268), to Air Alliance Inc., Air Nova Inc., AirBC Limited, and Air Ontario. We are writing to notify the Department that these permits have expired as a result of the liquidation of the holders and that the carriers have no plans to resume service to the U.S.

If some of this capital comes fro lines of credit or bank balances, we will also have to receive third-party verification of these balances of a recent date.

American Airlines, Inc. hereby objects to the request submitted on March 5, 2003 by United Air Lines, Inc. and Tyrolean Airways for a waiver of the 30-day notice requirement to begin codeshare services between Vienna and Skopje, Macedonia.
On January 21, 2003, American applied for exemption authority to serve Macedonia (and Yugoslavia) via Zurich under its codesharing arrangement with Swiss (OST-2003-14319). That application was unopposed, yet remains pending. Accordingly, American objects to special treatment for United/Tyrolean to serve Macedonia at a time when the Department has failed to act on American's Macedonia application in OST-2003-14319.
On February 6, 2003, Swiss submitted 30-day notice of Zurich-Skopje codeshare service with American in the American/ Swiss blanket codeshare authorization docket, OST-2002-12001.

A January 31 balance sheet and income statement are included at Attachment A. The company's financial position is essentially unchanged. While the company has experienced losses in the past two months, the winter season is traditionally a slow period and, indeed, highlights why USA Jet is proposing to operate limited passenger charter service during this period of the year. There have been no incidents, accidents or enforcement actions since the application was filed, and the key personnel remain the same except that Michael Hiller, Vice President Finance, has been replaced by Marc Belsky. Mr. Belsky's resume is enclosed at Attachment B; he is a U.S. citizen.
As your office is aware, the FAA CSET team reviewing USA Jet's planned passenger operations is interested in the status of the Department's decision on this application and we are working to facilitate contact between CSET and your office.
