Surreply of Continental Airlines and Motion for Leave to File an Unauthorized Document

Continental submits this surreply to eliminate any doubt created by Lan Ecuador's reply of January 29, 2003, that Continental is seeking authority from Ecuador aviation authorities to display Northwest's NW* code on Continental's U.S.-Ecuador flights and to discuss new information about Lan Chile.

Without presenting any evidence or other indication that its government is willing to grant codeshare authority to U.S. airlines or to authorize codesharing between Northwest and Continental, Lan Ecuador erroneously claims that Continental has not sought such codeshare authority from Ecuado ian aviation authorities. In fact, Continental submitted a codeshare request to Ecuador's Director General de Aviacion Civil on January 24, and Continental's Ecuador counsel met with Ecuadorian aviation officials on January 30 to discuss the request. At the meeting, Ecudorian officials advised that codesharing will not be approved unless each codeshare partner has a designation to operate to/from Ecuador and its own allocation of frequencies for the codeshare flights. Since there are insufficient frequencies available, this means that approval of the Continental/Northwest codeshare is impossible if such standards are applied.

Notice Concerning Additional Codeshare Points and Request for Waiver

US-Korea Blanket Codesharing

Pursuant to their blanket Statement of Authorization approval dated August 6, 1998 (#98-394), hereby notify the Department of additional codeshare services operated by Delta carrying KAL's designator code beyond KAL's Atlanta and Dallas/Ft. Worth gateways, as shown on Exhibit A.

Because the proposed services involve only U.S. domestic points, no codeshare safety or security concerns are implicated. Accordingly, the carriers request a waiver of the 30 day prior notice requirement.
