Respectfully
request that the Department grant the following authorizations to permit the
Joint Applicants to expand their Mexico-U.S. code-share/blocked space services:
a.
Exemption authority for one year to Aeromexico to the extent necessary to
permit it to engage in scheduled foreign air transportation of persons,
property and mail between San Jose del Cabo, Mexico, and Ontario,
California.
b. Exemption authority for two years to Delta to the
extent necessary to permit it to engage in scheduled foreign air
transportation of persons, property and mail between (1) San Jose del Cabo,
Mexico, and Ontario, California, and (2) Monterrey, Mexico and Las
Vegas, Nevada. Delta also seeks to combine this exemption authority with all
of Delta's existing certificate and exemption authority, consistent with
international agreements.
By this application, Aeromexico seeks an exemption to engage in scheduled foreign air transportation of persons, property and mail between San Jose del Cabo and Ontario. Aeromexico proposes to offer daily nonstop service in the market with MD-80 Series or other appropriate aircraft. Aerornexico's proposed service will provide travelers with first single plane and nonstop service in the San Jose del Cabo-Ontario market. In addition, Aeromexico seeks a statement of authorization permitting it to carry Delta's "DL" designator code on Aeromexico flights over both routes. Approval of the statement of authorization will enable Delta to offer first competitive service on the San Jose del Cabo-Ontario route and competitive service on the Monterey-Las Vegas route. Consequently, the proposed service clearly will provide significant benefits for U.S.-Mexico passengers and shippers.

BMAC notes that Pan Am had previously advised the Department, and the public, of its planned temporary suspension of operations between January 15 and February 13, 2003, and has taken exhaustive steps to insure that no passenger is adversely affected by Pan Am's reluctant and temporary suspension of scheduled services. Notwithstanding ALPA's professed skepticism about Pan Am's service resumption plans, Pan Am has already mailed recall notices to certain flight crew personnel, effective February 12. 2003, and dates shortly thereafter. It will also recall furloughed flight crew personnel earlier, as needed, to perform on demand charter flights.

Respectfully requests renewal of the exemption authority last granted by Notice of Action Taken dated January 17, 2001 to engage in charter foreign air transportation of persons, property and mail between any point or points in Iceland, via intermediate points, and any point or points in the U.S., and beyond; and other charters subject to 14 C.F.R. Part 212. The exemption authority currently is set to expire January 17, 2003, and by this application, Islandsflug intends to invoke the automatic extension provisions of 5 U.S.C. § 558(c) and Part 377 of the Department's Special Regulations. In light of 2002 amendments to the 1995 Air Transport Agreement between the U.S. and Iceland, Islandsflug further requests that the Department: (a) amend its authority to permit Islandsflug to engage in charter foreign air transportation of property and mail between a point or points in the United States and a point or points in a third country or countries; and (b) waive the requirement of 14 C.F.R. § 212.9(b)(1) that Islandsflug obtain prior Department approval before operating such fifth freedom cargo charters.

this application, Lan Ecuador seeks exemption authority in order to conduct
scheduled foreign air transportation of persons, property and mail between
Guayaquil and Quito, Ecuador. on the one hand. and Miami and New York, on the
other hand. Lan Ecuador intends to commence scheduled combination service
between Ecuador and the United States on or before April 1, 2003. Lan
Ecuador initially plans to operate seven weekly flights on each of the following
routes using Boeing 767-300 aircraft wet-leased from Lan Chile:
Guayaquil-New
York (JFK) (roundtrip)
Lan Ecuador's services will be conducted with Boeing 767 aircraft wet-leased from Lan Chile. Lan Ecuador also wet-leases A320 aircraft for other services.
Although Lan Ecuador believes that its ownership and control structure satisfies the requirements of Article 3(2) of the U.S.-Ecuador Air Transport Agreement , Lan Ecuador nevertheless respectfully requests a waiver of the ownership/control requirement. Waiver of the ownership and control requirement in this case would be consistent with the public interest and the Department precedent

Order 2003-1-10, the Department revokes the interstate scheduled passenger certificate issued to Air Excursions, LLC (Air Excursions) for reason of dormancy.
It has now been almost 22 months since Air Excursions was found fit to provide interstate scheduled service and it has yet to file the documents necessary to make its certificate effective or to file information on the effect that the changes in the law with respect to the carriage of mail may have had on Air Excursions' proposed operations. Under these circumstances, we will revoke, without prejudice, Air Excursions' certificate for reason of dormancy.
