With the approval of the Colombian Government, AVIANCA and ACES have formed a strategic alliance to enable both carriers to maintain viable, competitively effective operations between Colombia and the United States. The Colombian carriers' services to the U.S. have suffered severely from the decline in business traffic during the past year and the impact of the events of September 11 on travel to and from the U.S. In addition, the Colombian economy has been in recession for several years and the country continues to be embroiled in civil strife. As a result, ACES and AVIANCA have incurred financial losses that threaten their long-term competitive viability. The two carriers have therefore agreed to restructure and rationalize their operations and enter into a codeshare agreement. Under the carriers' codeshare agreement, AVIANCA will operate scheduled flights between Barranquilla/Bogota and Miami utilizing its own aircraft and crews and will display ACES' two-letter designator code on these flights. These codeshare flights will be operated in addition to those approved previously by the Department.
The Joint Applicants request a statement of authorization permitting AVIANCA to display ACES' designator code on AVIANCA's scheduled flights between Barranquilla and Bogota, Colombia, on the one hand, and Miami, Florida, on the other hand. AVIANCA's flights will be operated with B757 and B767 aircraft. Codeshare service will commence May 20, 2002.

I know you have talked over the phone with Kevin Adams
about Pacific Wings submitting a proposal, but time has elapsed and we wanted to
put something on the record. As we advised you by e-mail on January 22, 2002,
your rates at Hana, Kalaupapa, and Kamuela were then due to expire soon. One of
your rates has now expired, and two are due to expire soon. Specifically, your
rates were set to expire at Kalaupapa on February 28, at Hana on March 31, and
at Kamuela on April 30, 2002.

This serves as notice to the public of the action described below, taken by the Department official indicated. (No additional confirming order will be issued in this matter.) By Order 2002-2-18, issued February 27, 2002, served March 4, 2002, the Department requested proposals from air carriers interested in providing essential air service at Iron Mountain/Kingsford, Michigan; Manistee/Ludington, Michigan; Ironwood, Michigan/Ashland, Wisconsin; and Oshkosh, Wisconsin. These proposals were due within 20 days after the date of service of Order 2002-2-18, i.e., by March 25, 2002. We have received a request from Midwest Express Airlines for a ten-day extension of this due date. In support of its request, Midwest Express affirms that it will deliver to the Department of Transportation all required documentation on or before April 3, 2002.

On
February 21, 2002, you filed on behalf of Linea Aerea Puertorriquefa, Inc. an
application seeking interstate charter authority. However, a review of this
application indicates that LAP intends to conduct some scheduled passenger
operations. (See for example, item 11 on page 3 of the application where it is
stated that "all required materials for schedule service will be submitted
to the FAA, " and page 2 of Exhibit 7 where it is stated that "The
primary routes for operations will be between San Juan, Puerto Rico and Miami
and non-scheduled operations in other areas of the Caribbean. ")
If LAP does indeed intend to conduct scheduled passenger operations as
indicated in its filing, it will need to amend its current application
accordingly. If LAP does not amend its interstate application to seek scheduled
certificate authority, it must file a separate foreign charter certificate
application if it intends to conduct nonscheduled operations to points not in
the U.S. or its territories.
