Terminate Service Between Hickory, North Carolina and Charlotte, North Carolina |
Order 2002-3-26 is tentatively allowing CCAir, Inc., d/b/ US Airways Express (CCAir) to suspend its scheduled service at Hickory, N.C., on April 16, 2002.
Under
Public Law 106-69, the Department of Transportation and Related Agencies
Appropriations Act of 2000, the Department is precluded from compensating a
carrier under the Essential Air Service program for serving any community within
70 driving miles of a medium or large hub airport. Using a 1996 Rand McNally
software program, we have measured the distance from the center of Hickory to
the entrance of Charlotte/Douglas International Airport as 54 miles.
We
tentatively find, therefore, that we are prohibited from paying subsidy to CCAir
for providing air service at Hickory under the EAS program, and thus that we are
also precluded from requiring the carrier to continue service at the community
after the end of its 90-day notice period. Consistent with program practice, we
will give the community 20 days after the service date of this order to file an
objection if it believes that we have made a mistake in our distance
calculations.

Delta and Air France hereby notify the Department that notice given for Delta or either of its connection carrier affiliates, ASA and Comair, should be deemed notice given for all three carriers. This will assist Delta in maintaining the most efficient allocation of flying between mainline and connection carriers, without undue administrative burdens. A summary of the existing authorized codeshare service points for Delta, Air France, ASA and Comair is included at Attachment A. The Department has previously granted Delta and other carriers similar flexibility. See, e. g. , Department Action on Delta/SAA/Comair Application in Docket OST-99-6556 (August 27, 2001).

90-Day Notice of Intent to Terminate Service Muscle Shoals, Alabama |
On
August 24, 2000, Express Airlines 1, Inc., d/b/a Northwest Airlink, filed a
90-day notice of its intent to suspend its subsidy-free service at Owensboro,
KY, Muscle Shoals, AL, and Jackson, TN, effective November 22, 2000. By Order
2000-10-3, October 2, 2000, the Department prohibited Northwest Airlink from
suspending service at the communities for an initial 30-day period, through
December 22, 2000, and stated that we would issue subsequent 30-day hold-in
orders until we could secure replacement service. We issued Order 2001-3-21,
selecting Corporate Airlines to provide service at Jackson and Owensboro. That
service began on May 1, 2001. At Muscle Shoals, we have extended Northwest
Airlink's service obligation for additional 30-day periods, the latest through
March 25, 2002, by Order 2002-2-15.

Ninety-Day Notice for Suspension of Service at Gallup, New Mexico |
On behalf of the City Council of the City of Gallup, I hereby request the following: Mesa Airlines be retained under the existing EAS authorization extension until the City Council, in special session, can meet with representative of the four interested carriers. Invitations to them will be sent immediately. We should be able to arrange these discussions in the next few weeks. It is my understanding that a new, interim subsidy rate has already been established with Mesa so this proposed extension should not be a hardship for Mesa. Following these discussions, the City of Gallup can better respond to your February 22,2002 letter. The City of Gallup stresses that the invariable response from both the business community and the discretionary travelers of Gallup and the surrounding region demonstrates both a desire and need for Phoenix service.

Reissuance of Interstate Scheduled Passenger Certificates |
Order 2002-3-25 revoking the interstate certificate issued by Order 98-7-6 to Reeve Aleutian Airways, Inc. It has now been over one year since Reeve ceased all air carrier operations. To date, the carrier has not filed an application to resume operations, nor do we have any other information that would lead us to conclude that it plans to resume operations any time soon. Under these circumstances, we will revoke, without prejudice, Reeve's certificate for reason of dormancy.

Scheduled Commuter Air Carrier Operations |
On June 8 and August 17, 2001, we requested additional information from SkyMark, in particular, on the financial resources that were available to support its proposed operation. The carrier's responses, dated July 31 and September 4, did not satisfactorily answer our questions. On September 20, SkyMark requested that the Department defer action on its application for six months so that the company might secure the necessary financial resources. We granted this request on the same date. On March 5, 2002, SkyMark informed us that it was unable to conclude arrangements for working capital financing in an amount sufficient to meet the Department's established financial fitness test for new-entrant applicants. The carrier moved that we dismiss its application without prejudice to filing a new application in the future.
