Applies for an exemption from 49 U.S.C. § 41301 to the extent necessary to engage in the foreign air transportation of persons, property, and mail between points in Australia, other authorized points, and Denver, Colorado, via one or more of the U.S. co-terminal, or "gateway," points that Qantas is authorized to serve pursuant to its foreign air carrier permit issued by DOT Order 94-3-27. Qantas presently plans to serve Denver pursuant to a codeshare arrangement on American Airlines flights between Los Angeles and Denver that connect with Qantas flights in Los Angeles. Qantas bases this application on principles of comity and reciprocity as reflected in the excellent aviation relations between the United States and Australia.

The Air Transport Agreement between the Government of the United States and the Government of Australia (the "Bilateral Agreement") authorizes airlines designated by the Government of Australia to operate beyond specified gateway points to eight selected U.S. points (the "beyond points"), and Qantas' foreign air carrier permit authorizes Qantas to operate to those points. The Government of Australia has selected Boston, Las Vegas, Miami, Phoenix, Portland, San Diego, San Jose, and Washington, D.C. as Australian beyond points, and Qantas is presently offering services to those points pursuant to codesharing arrangements with American Airlines' and Alaska Airlines (Portland). (Qantas also serves all seven available gateway points by a combination of its own flights and code sharing on flights operated by the aforementioned US carriers.)

American Airlines will shortly file an Application to amend its Statement of Authorization in order to code share with Qantas on American's flights between Denver and Los Angeles.

Volga-Dnepr J.S. Cargo Airline

Permit Volga-Dnepr to operate one one-way all-cargo charter flight, utilizing Volga-Dnepr's AN 124-100 aircraft, to transport outsized cargo from Bradley International Airport, Connecticut to Andersen Air Force Base, Guam on or around March 28-30, 2002, on behalf of United States Department of Defense.

Volga-Dnepr will operate the flight on behalf of the United States Department of Defense as part of an effort to provide urgently needed lift to reach Guam not later than March 30, 2002. The DOD is shipping the helicopters to Guam in order to meet an aggressive schedule that requires replacement of certain equipment in the Pacific area. Given the extremely urgent need to move these helicopters in support of DOD operations, the military stands to face substantial operational delays in highly time sensitive operations if the mission is not completed within the set schedule, while only the use of Volga-Dnepr's outsized aircraft can make it possible to perform the service in question on time.
