Under the codeshare agreement between Mexicana and Lufthansa, Mexicana places its two-letter designator code on flights operated by Lufthansa between Chicago and Frankfurt and between Chicago and Munich. Lufthansa places its designator code on flights operated by Mexicana between Chicago and Monterrey/Leon. The Joint Applicants transport passengers only between Mexico and Germany under this codeshare-this service is not marketed or available to passengers originating in or destined for Chicago. Instead, Chicago is used by the Joint Applicants only as a transit point at which their respective Mexico-U.S. and Germany-U.S. flights connect.

the Department has granted identical U.S.-Canada blanket codesharing and blind
sector authority to United Air Lines, Inc. and Compania Mexicana de Aviacion. See

Hereby apply for a statement of authorization pursuant to 14 C.F.R. Part 212 authorizing Malev to display Delta's "DL" designator code on flights operated by Malev between New York (JFK), New York, and Budapest, Hungary, for the limited purpose of allowing Delta to transport U.S. mail on this route. The Joint Applicants plan to commence New York-Budapest mail-only codeshare service on or about May 1, 2002, and request that this application be granted by no later than April 1, 2002.
Malev operates the only nonstop service between New York and Budapest. Pursuant to the Joint Applicants' Mail Codesharing Agreement, which is attached hereto, Delta plans to offer the United States Postal Service the opportunity to send U.S. Mail over the New York-Budapest route under the "DL" code on flights operated by Malev. Segment 3 of Delta's certificate of public convenience and necessity for route 616 authorizes Delta to engage in, inter alia, foreign air transportation of mail between New York/Newark and Hungary. See, Order 95-3-25. Malev operates New York-Budapest service pursuant to its foreign air carrier permit issued by Order 90-6-42.

Based on our review of information supplied by ExpressJet in its application, we have decided to disclaim jurisdiction over the transfer of ExpressJet's certificates to Newco, and to reissue ExpressJet's certificates in Newco's name. We find that the proposed corporate reorganization will have no significant effect on the actual ownership, control, management, citizenship, financial condition, or operations of the carrier.' The FAA has advised us that ExpressJet's current operations are satisfactory and that that agency is aware of the carrier's restructuring plans. In similar circumstances in the past, the Department has disclaimed jurisdiction based on the conclusion that such corporate reorganizations were found not to be transfers within the meaning of section 41105 of the Statute. We reach that same conclusion here.

Federal Express Corporation respectfully requests that the Department act on the balance of its pending Application for Renewal of a Dormancy Condition Waiver filed on August 31, 2001. FedEx plans to begin operating one of its five U.S.Russia all-cargo frequencies upon receipt of all Russian government approvals. Unfortunately, operation of the other four frequencies remains uneconomical despite FedEx's active pursuit of opportunities to resume their use. Accordingly, FedEx asks that the Department waive the 90-day dormancy condition that applies to one of its five U.S.-Russia frequencies for ninety days to enable it to complete its startup plan. FedEx also asks the Department to grant the balance of its August 31 application, which was for a one-year waiver, for the other four frequencies.
Unfortunately, U.S.-Russia air cargo traffic continues to be depressed, although business conditions are changing. FedEx therefore plans to use one of its five frequencies to provide one weekly round trip between Memphis and Moscow via Paris. FedEx has applied to the Russian government for the necessary approvals for this flight and will initiate service as soon as it receives all such approvals.

Linda G. Cook and Emma P. Duggan vs. Northwest Airlines, Inc.

Discrimination Against any Otherwise Qualified Individual |
On February 4, 2000, Linda G. Cook and Emma P. Duggan filed a formal third-party enforcement complaint with the Department of Transportation alleging that Northwest Airlines, Incviolated the Air Carrier Access Act, 49 U.S.C. § 41705 and the Department's implementing regulation, 14 CFR Part 382, in a number of respects relating to requested wheelchair service. The Office of the Assistant General Counsel for Aviation Enforcement and Proceedings investigated the Complainants' claims and further reviewed similar complaints against Northwest by passengers with disabilities. This investigation led the Enforcement Office to conclude that Northwest had committed a significant number of apparent violations of 14 CFR Part 382 and resulted in it filing a formal complaint with the Department's Office of Hearings on September 7, 2001.
