By this application, Aeromexico seeks renewal of its exemption authority to provide service between Mexico City and Chicago. As noted above, it does not seek renewal of the authority between Guaymas and Los Angeles. The authority was granted by Notice of Action Taken, dated February 9, 2000, and last renewed by Notice of Action Taken dated March 29, 2001. It currently is set to expire on March 29, 2002. Aeromexico is offering round trip nonstop service in the Mexico City-Chicago market two days a week and it desires to continue providing such service in the future. In addition, Aeromexico is carrying the two letter designator code of Delta Air Lines, Inc. on the flights. The service being provided by Aeromexico has generated significant benefits for the traveling public and the code share arrangement has enabled Delta to offer competitive service in the market.

Air Jamaica Limited hereby applies for renewal of its exemption authority to engage in the scheduled foreign air transportation of persons, property, and mail between Kingston and Montego Bay, Jamaica, on the one hand, and Cincinnati, Ohio and Memphis, Tennessee, on the other. Notice of Action Taken in Docket OST-1997-3051, dated May 1, 2001. Air Jamaica currently plans to continue operating these Jamaica-Cincinnati and Jamaica-Memphis services under its code-share arrangement with Delta Air Lines, Inc.

Continental noted in its answer to American's original request for three
U.S.-Japan frequencies, American continues to hold at least seven unused
frequencies awarded to it for Boston-Tokyo service, as well as unused
frequencies allocated to it for Seattle-Tokyo and Dallas/Ft. Worth-Osaka
service. Continental has no objection to the use of four of the Japan
frequencies already held by American for Dallas/Ft. Worth-Tokyo service.

As this office continues processing the application of Caribbean Star Airlines, Inc. for a certificate to engage in scheduled and charter foreign air transportation, various issues arise for which additional information may be needed. Thus far we have identified the following areas that require additional information. The four permanent U.S.-Brazil frequencies Delta is seeking should not be reallocated from American. American will resume daily nonstop New York-Rio de Janeiro service effective January 8, 2003. American is presently operating such service five days a week, and has applied for a dormancy waiver in OST1999-6284 for two of the required frequencies until January 8, 2003. If the Department entertains Delta's application, there are many other dormant U.S.-Brazil frequencies available to fund Delta's request, including four held by Continental Airlines, Inc. (Newark-Rio de Janeiro), and seven held by United Air Lines, Inc. While United's seven are not subject to an explicit 90-day dormancy condition, United's frequencies should be placed in issue in any reallocation proceeding, along with Continental's.
American also has two other dormant Brazil frequencies. American will use those two frequencies (which are so-called "grandfather" frequencies not subject to a 90-day dormancy condition) for Miami-Rio de Janeiro service, effective January 8, 2003. Accordingly, as of that date, American will be using all 49 of its U.S.-Brazil frequencies.

Although neither Continental nor American objected to the continued award of four Brazil frequencies to Delta on a temporary basis so long as their own dormancy waivers were granted, Delta has opposed continuation of those waivers while seeking comparable waivers of its own elsewhere and asked for permanent allocation of four Brazil frequencies. Continental would not oppose the award of four permanent frequencies to Delta for continuation of its daily Atlanta-Rio de Janeiro service so long as Continental's application for continuation of its dormancy waiver for four Brazil frequencies is granted through December 31, 2002, and the four frequencies awarded to Delta are provided by transfers from American or United, the two U.S. airlines holding the most Brazil frequencies. Continental states as follows in support of its position.
American and United each hold more Brazil frequencies than either Continental or Delta and at least as many currently-unused frequencies as Continental. Moreover, despite significant new entry by Continental and Delta, American continues to dominate U.S.-Latin America traffic, with some 52% of the U.S.-flag enplanements, while United has steadily retrenched in Latin America. With international demand in Brazil dropping 5.2% in January 2002 compared to January 2001, the Federal Aviation Administration forecasting a 12% decrease in overall enplanements for 2002 compared to 2001, and the carriers' current and proposed Brazil schedules fluctuating widely, as their pleadings attest, this is no time to make long-term frequency allocations based on short-term startup criteria. Thus, if the Department is prepared to consider re-allocation of Brazil frequencies, it should wait until autumn rather than requiring carriers to outbid one another to retain their frequencies by forecasting flights to be operated later this year regardless of demand and economic conditions.

There continues to be a significant number of dormant and unused U.S.-Brazil frequencies, for which other carriers have no immediate - or in some cases indefinite - service plans. In these circumstances, it is both unnecessary and unfair to subject the Georgia/Atlanta community to the continued risk of loss of this important service benefit.

Continental Micronesia urges the Department to grant Continental Micronesia's request for a waiver of the dormancy conditions applicable to its Honolulu-Tokyo flights through March 28, 2003, asks the Department for leave to submit this reply, and replies as follows to American's answers. American has presented no valid basis for denying the Continental Micronesia request for a waiver of the dormancy conditions on its Honolulu-Tokyo frequencies through March 28, 2003. American has not even applied for additional Japan frequencies to offer Los Angeles-Tokyo service, and it has not even "planned" service to begin until after the expiration of the dormancy waiver sought by Continental Micronesia. American already holds 14 of the 42 unrestricted frequencies available and will use them for its own New `York and Chicago-Tokyo flights. Between American's own flights and service offered on flights operated by its codeshare partner, Japan Air Lines, American will offer some 55 weekly flights on restricted U.S.-Japan city-pair routes as of April 2002.3 In addition to significant' changes in the U.S.-Japan air transportation market which may well occur between now and March 31, 2003, the bilateral regime governing U.S.-Japan operations will be the subject of meetings between the U.S. and Japan between now and summer 2003. The results of those meetings, as well as possible changes in the commercial marketplace, could well affect the availability of frequencies and American's plans to operate additional flights. Under these circumstances, the Department should grant the waiver sought by Continental Micronesia pending further developments affecting U.S.-Japan routes.
