In
order to obtain maximum operating flexibility, and consistent with the MOC, the
joint applicants request codeshare authority for each of the five additional
U.S. codeshare cities (Baltimore, Las Vegas, Pittsburgh, Raleigh/Durham, and St.
Louis) from each of Turkish Airlines' presently-served U.S. gateways (Chicago
and New York). American and Turkish Airlines propose to begin the additional codesharing
services at issue herein on April 7, 2002.

Daystar Airways, d/b/a Nevis Expresshereby files its comments on the Application of Caribbean Star Airlines. Inc. in this docket, and subsequent additional filings and supplements. Daystar also requests permission to file its comments late. These comments depend on material that was not available until last week. For some time, Daystar has awaited permission to operate scheduled service to several of the points proposed for service by CSA. Daystar has been designated for service by the U.S. Department of State. At this time, however, Daystar has yet to receive permission to operate from some of the largest and most significant points at which it has been designated by the United States, most principally Antigua and Barbuda. Correspondence received from the United Kingdom on behalf of Antigua and Barbuda, and a recent article in the Wall Street Journal make it clear that if CSA were to be certificated as requested, it would enjoy and unfair and anti-competitive business advantage vis-a-vis Daystar. While none of this results directly or indirectly from actions or interests of CSA, the arbitrary and capricious actions of Antigua and Barbuda make it clear that it will not abide by its bilateral agreement governing commercial air service unless the United States forces compliance with both the letter and spirit of the agreement. While Daystar does not wish to impede the certification of CSA, it opposes the certification until the Government of Antigua and Barbuda fully grants the authority designated to Daystar by the Government of the United States.
While CSA has presented a voluminous application supporting its application for authority, there are two separate shortcomings that undermine the credibility of the application and suggest that CSA is not currently financially fit within the Department's definitions and requirements. According to CSA-1 11, a line of credit of 54,800,000 is used to support CSA's claim of financial fitness, and that the total current capitalization exceeds D.O.T. guidelines by $84,939. While there is no question that the line of credit is valid, the amount appears inadequate to meet the Department's standards. This is because CSA appears to have underestimated its operating and pre-operating expenses.
