Enclosed are several
examples of airfare price discrimination. These examples use comparisons to US Airways
and Delta Airlines, with differences up to 70% between the web fare and our CRS
fares via Galileo. However, we are getting calls from clients almost every day
making comparisons to internet fares of all airlines.

Extension of Computer Reservation System Rules |
I am enclosing printouts from my CRS (Amadeus) and U S airways web site for fares involving travel from Boston to Philadephia in February. Although I realize that some web fares are often slightly lower than our CRS fares, this example is typical of some of the major discrepancies I find. The fare difference is $572.50! Many passengers do not have access to the internet, or do want to book through the internet, and prefer to use the services of a travel agent. I cannot provide the services my clients have been accustomed to if I cannot access all the fares an airline offers.

American Airlines, hereby answers the application submitted by Delta Air Lines, Inc. on February 26, 2002, seeking a waiver through April 1, 2003 of the dormancy conditions it states are applicable to a total of 34 weekly U.S. Japan frequencies (Los Angeles- Nagoya, seven; Los Angeles- Tokyo, seven; New York- Tokyo, seven; Portland- Osaka/Fukuoka, 13). American opposes the grant of a dormancy waiver (where applicable) to Delta's Los Angeles- Tokyo and New York- Tokyo frequencies. If, however, a waiver is granted, it should be strictly limited to a period of six months, to expire on October 1, 2002.
Under the 1998 U.S.-Japan MOU, 28 special frequencies were created that can be used by U.S. carriers to serve Japan from certain restricted gateways, including New York, Chicago, Los Angeles, San Francisco, and Honolulu. In Delta's application, one Los Angeles-Tokyo frequency and seven New York-Tokyo frequencies (see footnote 1) constitute eight of these 28 special frequencies.
American is planning to institute daily nonstop service between Los Angeles and Tokyo in the summer of 2003, and will require an allocation of seven special frequencies under the 1998 MOU to do so. American will apply for such an allocation in due course. In that application, American will ask that its proposed Los Angeles-Tokyo service be funded from among Delta's eight dormant special frequencies, and Continental Micronesia's five dormant special frequencies.

We have been in business and using the trade name Freedom Air since 1976. We operate as a Flag Carrier under FAR 121 and Commuter FAR 135. The public's ability to differentiate between Freedom Air and Freedom Airlines has not been without error, as we have been incorrectly referred to as Freedom Airlines on several occasions. Therefore we suggest that you find another name for your carrier.

The purpose of this Application is to authorize Pan Am to extend its existing scheduled passenger operations to the Dominican Republic, through the operation of scheduled flights six days a week between points in the United States and points in the Dominican Republic, as described below. Pan Am plans to begin service to the Dominican Republic on or about July 1, 2002, or as soon thereafter as all necessary Dominican licenses have been obtained.
Pan Am plans to commence scheduled passenger service between points in the U.S. and points in the Dominican Republic on or before July 1, 2002. Pan Am's initial service will be provided six days a week at a frequency of 44 flights a week serving Portsmouth, NH, Newark, NJ, Miami, FL and San Juan, PR in the U.S., and serving Santo Domingo, Santiago, Puerto Plata and Punta Cana in the Dominican Republic. Pan Am's Dominican Republic service will be operated utilizing B-727-200 aircraft configured to carry 149 passengers in spacious "Clipper Class" seating. The aircraft to be utilized are part of Pan Am's existing fleet of seven B-727200 aircraft.

Polar's two U.S.-Saudi Arabia all-cargo frequencies were initially issued to support Polar's U.S.-South Africa services that operated from the U.S. via Ostend, Belgium; Jeddah, Saudi Arabia; and points in Africa (Nairobi and Harare) to Johannesburg, South Africa. After Polar suspended service over this routing due to market conditions and restrictions on Polar's services via Nairobi and Harare, the Department granted Polar waivers of the dormancy conditions applicable to its two U.S.Saudi Arabia all-cargo frequencies as well as similar conditions applicable to frequencies separately allocated for U.S.-South Africa services. The waiver with respect to U.S.Saudi Arabia frequencies was most recently renewed by Notice of Action Taken dated April 12, 2001. That waiver was scheduled to expire on January 10, 2002, but was extended through March 31, 2002 by the Department's blanket waiver in Order 01-1115.
By this application, Polar seeks to extend the dormancy waiver applicable to its U.S.-Saudi Arabia all-cargo frequencies. Polar is now planning to resume scheduled all-cargo services to Jeddah, Saudi Arabia in the Fall of 2002. These services would operate on a U.S.-Europe-Saudi Arabia-Southeast Asia routing and would serve Jeddah, Saudi Arabia twice weekly. Current plans call for this service to begin in September.
Polar requests an extension of its U.S.-Saudi Arabia dormancy waiver through October 26, 2002. That is the date designated by the FAA for the termination of its blanket waiver of the use-or-lose rules applicable to slots at U.S. high density rule airports.
