In response to the question regarding FAA's approval of Air West personnel holding positions with entities other than Air West, the documents I referred to are the documents from our FAA Principal Operations Inspector Mirlo (Eddie) Ochoa. These documents approve each person for the positions held. Mr. Ochoa knows our personal and their employment situations other than with Air West. If he thought it would interfere with our operations, I don't think he would have approved the positions.

I am a small agency owner and I feel that the internet has the potential to undermine the relationship between agents and clients. Orbitz must be under the same guidlines as anyone else who sells through CRS. Orbitz has caused numerous problems with my clients. I quote Jani Miller, CEO Central Travel, "Our concern about this marketplace reality is huge. The immediate impact on the customer is comfustion, distrust, loss of productivity and, at times, mothing more than a marketing ploy." I wholeheartedly agree. I don't see how the airlines are allowed to withhold the lowest fare from the general public. Most of my clients in rural Georgia don't have internet access and can not even purchase these tickets themselves. Of course, my corporate clients have access to computers, but spend more time questioning the fares from the airlines to which we have access, than is necessary. I understand the need for competitive marketing, but if you have someone out there selling for you, why undersell them? You only create confusion and make the agents as well as the client distrust the airlines.

El Al plans to commence Tel Aviv-Toronto-Los Angeles service, and the Joint Applicants plan to commence Los Angeles-Toronto codeshare service on or about April 1, 2002, and request that this application be granted by no later than March 12, 2002. The Joint Applicants request that the statement of authorization be effective for an indefinite term, subject to the Department’s usual conditions. El Al requests that its exemption authority remain effective for a period of at least two years.
On or about April 1, 2002, El Al plans to introduce scheduled one-stop single-plane service between Los Angeles and Tel Aviv via Toronto with full traffic rights, as authorized by the ad referendum agreement between the Governments of the United States and Israel signed on January 10, 2001. Pursuant to the Joint Applicants’ codesharing agreement, which was previously submitted to and approved by the Department in Docket OST-2001-8772, Delta plans to display its designator code on the Los Angeles-Toronto (and vice versa) segment of El Al’s flights. Delta will independently market and sell such transborder services to its customers.

Freedom Airlines was organized as a corporation under the laws of the State of Nevada on December 3, 2001, by Mesa Air Group, Inc. (Group), the parent company of Mesa Airlines, Inc., Air Midwest, Inc., and CCAir, Inc., all certificated air carriers.3 Group formed Freedom Airlines for the purpose of operating as an America West code share partner utilizing 64-seat Canadair Regional Jet (CRJ) 700 and 80-seat CRJ-900 aircraft currently on order for Mesa. While Mesa will continue various operations it currently conducts on behalf of America West and US Airways,4 it will assign the regional jet flights it operates on behalf of America West to Freedom Airlines.
If granted the certificate authority it seeks, Freedom Airlines will commence regional jet operations operated on behalf of America West under a code share arrangement. Under this arrangement, Freedom Airlines will be responsible for all aircraft operations, while America West will handle all marketing and passenger ticketing matters such as the collection of passenger funds and the processing of all refunds. America West will compensate Freedom Airlines for its services without regard to the number of passengers carried. That is, America West will purchase from Freedom Airlines all of the available seat miles and is assuming the financial burden for any shortfall in passenger and other revenue. Freedom Airlines forecasts that it will operate a total of nine 64-seat CRJ-700s and two 80-seat CRJ-900s by the end of its first year of actual flight operations under the of America West arrangement, flying a total of 15,605 aircraft block hours. The applicant expects to expand these operations during its second year of operations to include an additional 11 CRJ-700s and 13 CRJ-900s.
Mesa presently operates over 70 regional jet and turboprop aircraft in scheduled service under the trade names "America West Express," "USAirways Express," and "Frontier JetExpress." In addition, Mesa operates, or will soon operate, other aircraft in partnership with Midwest Express. Further, Air Midwest and CCAir also conduct operations as "USAirways Express." In total, Mesa and its sister companies currently operate approximately 116 aircraft.

Chautauqua/American Connection will discontinue its one daily nonstop round trip between Sioux City, IA and St. Louis, MO. The last date of service from St. Louis to Sioux City will be March 31. The last date of service from Sioux City to St. Louis will be April 1, 2002. It is our understanding that TransStates Airlines, operating as American Connection, will also eliminate its round trip nonstop Sioux City - St. Louis service on March 31. Hence, the last nonstop service in a domestic market will be terminated.

United requests renewal of its authority to serve South Africa through its Certificate of Public Convenience and Necessity for Route 747, which authorizes it to operate scheduled foreign air transportation of persons, property and mail between a point or points in the United States, the intermediate point Frankfurt, Germany, and the coterminal points Johannesburg and Cape Town, South Africa, and beyond South Africa to Harare, Zimbabwe. The certificate also allows United to combine the services over the authorized route with services United is authorized to operate in other certificates and exemptions, subject to standard conditions. This authority was approved by Order 97-1014 for a five year period. The authority will expire on October 23, 2002.
Pursuant to its certificate for Route 747, United currently offers 'scheduled transportation between the United States and Johannesburg and Cape Town via Frankfurt under its codeshare arrangement with Lufthansa. United plans to continue such codeshare operations to South Africa under its renewed certificate authority.

Volga-Dnepr will operate the flight on behalf of Lockheed Martin as part of an effort to provide urgently needed lift to reach Cape Canaveral not later than the scheduled shipment date. Lockheed Martin is shipping the Payload Fairing Containers to Cape Canaveral to complete an aggressive schedule that includes first flight article receipt and subsequent launch processing. The initial receipt for the articles is March 27, 2002. As a result, Lockheed Martin stands to loose millions of dollars if the shipment does not occur on time, while only the use of Volga-Dnepr's outsized aircraft can make it possible to perform the service in question within the set schedule.

Approval and Grant of Antitrust Immunity for Third-Party Technical Advisers to Participate in PASDEX |
In support of its application, IATA states that in May
2001, the PAC established PASDEX to maintain the data interchange standards for
the exchange of passenger ticketing-and related settlement data among
airlines, agents and global distribution systems. PASDEX's role is advisory; it
will make technical recommendations to the IATA Global Customer Advisory
Committee-Passenger. If those recommendations are adopted by the committee and
subsequently by the PAC, they will be submitted to the Department for review and
approval..
IATA states further that in the past, the Department in a
series of orders has given approval and immunity for third parties specializing
in data exchange standards and procedures, such as CRS vendors, ticketing system
providers, software suppliers, and data processing centers, to participate as
technical advisers to the technical facilitation working groups that preceded
PASDEX.
PASDEX is assuming the responsibilities formerly assigned to the Data Interchange SubGroup (DISG) and the Billing and Settlement Plan Committee (BSPC) Support Group (BSG). The Department in Order 98-4-20, April 17, 1998, gave approval and immunization for third parties to serve as technical advisers to DISG and BSG, but under the terms of the order, approval for such third party participation expired with the dissolution of the BSPC and DISG in 1999. Both have now been reconstituted as PASDEX.
