Hereby respectfully applies for an amendment to its current exemption from 49 U.S.C. §41301 to the extent necessary to enable Aero Continente to engage in: the scheduled foreign air transportation of persons, property and mail from points behind Peru via Peru and intermediate points to a point or points in the United States and beyond.
On June 10, 1998 (entered into force on February 8, 1999), the governments of the United States and Peru signed the "Open Skies" Air Transport Agreement. Under Annex I of this Agreement, the airlines of Peru are entitled to operate scheduled services "from points behind Peru via Peru and intermediate points to a point or points in the United States and beyond. 112 Aero Continente requests herein amended exemption authority that is co-extensive with this grant of rights.
Aero Continente is fit, willing and able to perform the services encompassed by this application. Aero Continente currently holds exemption authority authorizing it to conduct scheduled combination services between Lima, Peru, and Miami, FL; Ft. Lauderdale, FL; New York, NY; Los Angeles, CA; and San Juan, PR via intermediate points, using wet leased aircraft.

Hereby applies for an amendment of the Statement of Authorization that the Department granted on April 6, 2000, for Gemini to operate code share service for Qantas Airways Limited. The present statement of authorization grants Gemini authority to code share with Qantas on the Los Angeles-Honolulu-Nadi-Sydney routing. This application seeks an amendment of the Statement of Authorization in order for Gemini to add New York, Toledo, and Pago Pago, American Samoa, to the previously approved routing, i.e, New York - Toledo - Los Angeles - Honolulu - Nadi/Pago Pago - Sydney. Gemini plans to operate either DC-10-30F or MD-11F aircraft on its expanded codeshare flights.
Gemini holds a certificate of public convenience and necessity to operate scheduled foreign air transportation of property and mail to points in Australia and in Fiji. Order 99-12-7, issued October 13, 1999, effective January 12, 2000.
The Department also approved an earlier codesharing arrangement between Gemini and Qantas on the LAX - HNL - NAN - SYD routing. Statement of Authorization No. 98-81 (August 31, 1998). Qantas holds an exemption that authorizes Qantas, inter alia, to operate scheduled and charter foreign air transportation of property and mail from points behind Australia, via Australia and intermediate points, to points in the United States and beyond. In 1999 the United States and Australia agreed to amendments to the Air Transport Agreement between the United States and Australia ("the Agreement") that specifically authorize codesharing arrangements such as the one between Gemini and Qantas. The amendment is not yet in effect, but the Memorandum of Consultations addresses the status of the amendment pending its formal approval.
Gemini requests a waiver of Part 212.10(d) that requires that applications for codeshare statements of authorization shall be filed 45 days before the date of the first flight. Gemini and Qantas have only recently finalized the terms of their commercial arrangement under which the codeshare arrangement will be broadened to include New York and Toledo. In view of desire of Gemini and Qantas to operate codeshare flights from New York and Toledo as soon as possible, Gemini will poll the parties on the service list and request immediate approval of this statement of authorization application. Due to improving markets, Gemini and Qantas are expanding their codeshare arrangement to include New York and Toledo after a hiatus in codeshare operations prompted by a downturn in the business cycle.

Linea Aerea Puertorriquena, Inc. will operate a Boeing 727-200 aircraft in its Air Carrier Certificate in accordance with the requirements of Part 1191121 operations. The company will operate the aircraft as indicated in section 9 of this application. Training will be conducted under contract with Pan Am Flight Academy Facilities at Miami, Florida. The aircraft will be maintained by contract with Arrow Air at Miami, Florida for inspections and Linea Aerea Puertorriquena will provide routine maintenance in San Juan, Puerto Rico. The Company maintains a principal base of operations at San Juan Airport, CAS Building, San Juan P.R..
