On December 20, 2001, the Air Carrier Association of America wrote you to urge once again that the Department immediately suspend or revoke the authority set forth in 14 CFR Section 255.10 that allows a dominant hub carrier, through purchase of GDS transaction tapes, to obtain information about other carriers' transactions including the class of services, price paid, date of purchase and route selected. As noted in Mr. Faberman's letter, Section 255.10 has had an adverse effect on corporate and airline negotiations. The current rule allows carriers to monitor the ticketing activities of travel agencies and major corporations, which not only damages corporate negotiations, but also creates privacy issues between the corporation, carrier and the travel agency. Under Section 255.10, the corporation will have no control over how an airline uses their data and the proprietary nature of the data. The current rule unmasks the travel patterns and tendencies of corporations, allowing airlines, including ones a corporation is not contracted with, to sell and purchase a company's travel data.

While we certainly understand that the current state of the industry has prompted schedule cutbacks for all airlines, the complete termination of Mesaba service leaves ESC without an essential link to its most vital hub, Detroit Metropolitan Airport. Service termination also results in a 71 percent reduction in seat availability for the travelers using ESC.

Senior management at Northwest Airlines, which provides scheduling and fleet planning functions for Mesaba, has indicated that ESC service is not financially viable. Because ESC will still retain service to another designated, but much smaller hub airport, no financial subsidy will be available to retain Mesaba service under the Essential Air Service program.

This situation underscores the shortcomings of the current EAS program which, while guaranteeing a minimum number of flights, fails to provide adequate financing for sustainable levels of air service. We believe additional EAS funding to support appropriate levels of air service would enable many airports, including ESC, to eventually become profitable and self-sustaining.

Thank you for your letter of October 10 requesting clarification as to the standards being applied under the direct compensation provisions of the Air Transportation Safety and System Stabilization Act, P.L. 107-42, (Act). In particular, you expressed concern over whether the Department was complying with Congressional intent, and was acting consistently, regarding computation of air carrier losses on a pretax or after-tax basis. On October 25, the Department published in the Federal Register a Final Rule entitled "Procedures for Compensation of Air Carriers."
