The Department's own studies and reports along with testimony of Department officials have acknowledged that dominant incumbent carriers take various steps to drive new entrants out of markets by monitoring and responding to all actions taken by the new entrant. An incumbent carrier that controls 80 to 90 percent of a hub airport and an entire area of the country has various anti-competitive tools available to it. Obtaining a competitor's sales information from a computer reservations system through a Department regulation increases that carrier's ability to control its markets.

The regulation that aids and abets action against new entrants is Section 25 5.10, which allows a carrier to obtain information disclosing a competitor's ticket information. The data also allows carriers to monitor sales by travel agencies. Because of the importance of this information in combating a competitor's attempt to enter a hub, it adds to the anti-competitive weapons available to dominant carriers.

It is imperative that the public continue to be protected from unreasonable price increases by the present certificate holders. The entire history of this industry offers convincing proof that, in the absence of competition or a realistic threat of competition from new low-cost carriers, competition among the existing certificated carriers cannot be relied upon to hold prices to a reasonable level.

Competition and new entry was to be the future of the deregulated era. The opposite has occurred. There is no reason why the Department cannot take this small step to preserve competition and support travelers and businesses from throughout the country.
