Notice of Action Taken New York/Boston- Tokyo Dormancy

By Order 98-5-17, the Department granted certificate authority to American to provide service between New York and Tokyo and between Boston and Tokyo, and allocated it a total of fourteen weekly frequencies to operate seven weekly frequencies in each market. The frequencies are subject to the condition that they will expire automatically and revert to the Department for reallocation if they are not used for a period of 90 days. The Department has previously granted American waivers of the dormancy condition for its New York-Tokyo and Boston-Tokyo services. American seeks a further waiver of the 90-day dormancy condition for an indefinite period or, alternatively, for a period of at least six months. It states that the necessary slots at Tokyo's Narita Airport are still not available for the inauguration of its service in these two markets.

Mexicana and United now wish to further extend their codeshare services to two beyond-Mexico markets served by Mexicana. Within forty-five days of approval of this application, United will place its two-letter designator code on Mexicana's nonstop flights operated between Mexico City and Guatemala City/Panama City.

Mexicana holds authority from the Mexican Government as well as the Governments of Guatemala and Panama to operate services between points in these countries and Mexico City. To implement its codeshare with United, Mexicana requires from the Department only a statement of authorization permitting it to display United's designator code on flights in the Mexico City-Guatemala City/Panama City markets. United is authorized to serve Guatemala City and Panama City via Mexico City pursuant to its Certificate of Public Convenience and Necessity for Route 566, renewed and reissued by Order 2000-5-31.

HIA is authorized to provide scheduled foreign air transportation, under wet lease arrangements with a duly authorized and properly supervised U.S. or foreign air carrier, of persons, property and mail between Port au Prince, Haiti, on the one hand, and Miami Florida and New York (including Newark), on the other hand. HIA's authority was most recently reissued in this docket on March 21, 2000, and remains effective until March 21, 2001.

As detailed in its renewal application of March 2, 2000 in this docket, HIA has operated wet leased operations using the aircraft of Lan Chile and other duly authorized carriers.

Immediately prior to the May 1992 suspension of services, JAT was providing daily nonstop service between points in Yugoslavia and New York (JFK) and four flights per week to Chicago (ORD), using DC-10-30 equipment. JAT also conducted public charter flights with this same type aircraft between major U.S. cities and points to serve large populations of Yugoslav ethnic origin.

In this Second Amended Exemption Application, JAT requests authority to resume scheduled services using 271-seat DC-10-30 aircraft, beginning on May 14, 2001. JAT will offer only three Belgrade originations per week in the initial year of operations, serving New York (JFK) on a nonstop basis. In addition, JAT requests public charter authority for flights between points in the U.S. and points in Yugoslavia.

JAT would operate only a very limited number of such public charter operations during the year, depending on equipment availability. Such flights would primarily serve the same Yugoslav ethnic communities in several major U.S. cities that JAT has previously served. As with previous passenger charters, JAT requests the right to commingle, on the same aircraft, passenger charter traffic originating in the U.S. with passenger charter traffic originating in Yugoslavia.

The applicant first begin nonstop services between Yugoslavia and the United States in 1970, starting with charter flights and followed by scheduled services in 1977. These flights continued until May, 1992, at which time they were suspended for foreign policy reasons. At that time, the applicant had some 10,000 employees at 65 offices worldwide. With the improvement in international relations following the Dayton Accords, the applicant has resumed international services, serving most major European nations, and Russia, Israel, Egypt, Greece, Jordan, Malta and other destinations. U.S.- Argentina Combination Charter Opportunities

By this notice we advise U.S. carriers of the available combination charter opportunities between the United States and Argentina in accordance with the U.S. -Argentina Air Transport Services Agreement, as amended on November 24, 2000.

The Agreement provides that:

The Agreement also provides that charter flights in excess of the limits set forth above shall be given favorable consideration on the basis of comity and reciprocity. Each country is responsible for allocating the available charters among the airlines and notifying the other country of its distribution of charters.

In order for the Department to meet its obligations under the new amendment, we will provide to the carrier a Notice of Consistency for each charter flight or program that U.S. air carriers will operate in the U.S.-Argentina market. The carrier should include the Notice of Consistency in its application to Argentina for charter flight approval.

As soon as arrangements are firm for operating a charter flight to or from Argentina, U.S. carriers interested in operating flights should advise the U.S. Air Carrier Licensing Division (X-44), Office of International Aviation, in writing so that we may provide them with a Notice of Consistency acknowledging their right to perform the charter operation. All submissions should include, at a minimum, the following information: (a) type of charter--passenger only or combination; (b) the number of flights to be operated; (c) flight dates; (d) the charterer(s); (e) the city-pair markets involved by direction; and (f) the type of aircraft to be used.
