Hereby requests renewal of the exemption authorities granted to it by the Department of Transportation in the above-captioned dockets authorizing Braathens to perform scheduled foreign air transportation of persons, property and mail between (i) Minneapolis, Minnesota, and Oslo, Norway, pursuant to a codeshare agreement with Northwest Airlines, Inc. and (ii) Amsterdam and points in Norway, Norway and points in Sweden and Denmark, and points in Norway, pursuant to codeshare agreements with Northwest and KLM Royal Dutch Airlines.
Pending in Docket OST-99-5053 is Braathens, request to amend its existing exemption and statement of authorization to permit it to display the codes of Northwest and KLM on Braathens' flights between London and Norway. Braathens renews its request for prompt approval of this long-pending amendment to its operating authority. Braathens had planned to begin this service on March 27, 2001. In addition to jeopardizing the commencement date, the uncertainties created by the excessive delay in approval of this unopposed amendment, which has been before the Department since April 27, 2000, have created significant planning and marketing difficulties for Braathens.

The Department initially granted two-year exemptions authorizing Delta to provide service on the U.S.-Baku/Tashkent (Docket OST-99-5459) and U.S.-Tbilisi (Docket OST-99-5594) routes by Notices of Action Taken dated May 4 and May 17, 1999, respectively. Delta originally provided service to Baku and Tbilisi on a third-country codeshare basis with Austrian Airlines, but that arrangement has been discontinued. Delta nevertheless seeks renewal of its exemption authority for all three points to provide it with the flexibility to resume or commence service with its own aircraft or in conjunction with its codeshare partners, as market conditions warrant.

Exemption from 49 U.S.C. 41301 to conduct charter foreign air transportation of persons, property and mail between any point or points in Switzerland and any point or points in the United States, either directly or via intermediate points in other countries, with or without stopovers, and beyond, pursuant to the U.S.-Switzerland Air Transport Agreement; and other charters pursuant to 14 CFR 212 of the Department's regulations.
The authority is provided for in the U. S.-Switzerland Air Transport Agreement. We found, based on the record, that the carrier is properly designated and licensed, and operationally and financially qualified to undertake the proposed operations. ' The record also indicates that the carrier is owned 60% by citizens of Switzerland, 36% by citizens of Monaco, and 4% by citizens of Greece. Despite the presence of non-homeland interests, we found that there was nothing in the ownership and control of the carrier that would be inimical to U.S. aviation policy or interests. Therefore, we concluded that waiver of our standard requirement that substantial ownership and effective control of a foreign carrier rest in the hands of citizens of its homeland was warranted. Finally, the FAA has advised us that it knows of no reason why the Department should act unfavorably on the carrier's application.

The considerations that caused the FAA to limit the number of AIR-21 flights at LGA are applicable today, and the granting of exemptions from the high density rule at LGA under 49 U.S.C. §41714(c) would have the same adverse effects as the granting of exemptions under AIR-2 1. The necessity to limit operations at LGA to 75 per hour, at least until a permanent demand management policy is implemented, has not abated. The policy considerations supporting America West's application are not different in kind, and do not appear more weighty, than those supporting the statutory exemptions in AIR-21. The FAA recognized that those considerations were outweighed by the problem of congestion at LGA when it established the 75 operations per hour limit. Similarly, America West's application should be denied to avoid upsetting the status quo established at LGA by the FAA to address congestion pending implementation of a longer term solution.

The Department could not rationally conclude that awarding the slot exemptions for Columbus service requested by America West would serve the public interest when Congressional determinations that the public interest requires unrestricted small-community service at LaGuardia by aircraft with fewer than 71 seats are being ignored. Columbus today receives LaGuardia service from America West and three other carriers: Delta today offers 21 weekly flights, American offers 25 weekly flights and US Airways offers 23 weekly flights. Even without the additional slot exemptions it seeks, America West can continue to operate two daily roundtrips between LaGuardia and Columbus (see America West application at 3) and add Columbus flights at other New York/Newark airports.
