Perform scheduled foreign air transportation of persons, property and mail between Mumbai (Bombay) and other points in India, on the one hand, and Los Angeles, CA, on the other hand, via Kuala Lumpur, Malaysia, pursuant to a codeshare agreement with Malaysia Airlines ("MAS"). Air-India also intends, as permitted under the U.S. India Memorandum of Consultations, to exercise fifth freedom traffic rights between Los Angeles, CA and Kuala Lumpur, Malaysia. Air-India plans to begin advertising and selling Los Angeles-India codeshare service via Kuala Lumpur as soon as all necessary approvals are received so that service may be initiated on March 25, 2001. Air-India requests that this authority be granted for at least a two (2)-year period. All flights will be performed with modem A-330. B-777 or B-747 aircraft meeting all applicable noise requirements.
Two (2) U.S. combination carriers - Delta and Northwest - operate their own services with fifth freedom traffic rights to India, while United markets its services to India pursuant to a codeshare agreement. Two (2) U.S. all-cargo carriers - Federal Express and UPS - also operate their own scheduled services to India from the U.S. Grant of the exemption authority sought herein will permit Air-India to continue to Incrementally Increase its U.S. marketing presence and competitive posture.

In order to obtain maximum operating flexibility, and consistent with the MOC, American requests codeshare authority for each of the five additional cities (Cleveland, Denver, Detroit, Minneapolis/St. Paul, and Philadelphia) from each of Turkish Airlines, three U.S. gateways (Chicago, Miami, and New York).

Continental urges the Department to renew its exemption to integrate its authority to provide scheduled foreign air transportation of persons, property and mail under its certificates for Routes 29-F, 59, 82-F, 110, 157, 165, 176, 381, 383, 482, 509, 561, 629 and 659, its general domestic certificate as reissued by Order 98-7-6 and its exemption authority so it can provide foreign air transportation involving any points on these certificates of public convenience and necessity and exemptions. Continental asks the Department to renew its route integration authority exemption for an indefinite period or, in the alternative, for a period of at least two years.

Continental is currently operating seven weekly frequencies between New York/Newark and Quito via Bogota and seven weekly frequencies between New York/Newark and Guayaquil via Panama City. Continental's exemption authority and frequency allocations for New York/Newark- Quito via Bogota and New York/Newark- Guayaquil via Panama City were originally granted by Notice of Action Taken dated February 14, 1996 and by Order 96-7-4, respectively. The exemption authority and frequency allocations for both routes were most recently renewed by Notice of Action Taken dated May 10, 1999, and, absent renewal, they will expire on May 10, 2001.

MAS hereby requests a statement of authorization to the extent necessary to display Air India's designator code on MAS flights between Los Angeles and Kuala Lumpur and on MAS flights between Kuala Lumpur and Mumbal, Bangalore and Hyderabad, India. thereby allowing Air India to provide both U.S.-India and U.S.-Malaysia service on a codeshare basis on MAS flights. MAS currently operates daily round-trip service between Kuala Lumpur and Los Angeles and a total of seven weekly round-trip flights between Kuala Lumpur and the three points in India.

U.S.- Philippines Route 2 |
Allocation for two years of 1 weekly round-trip U.S.-Philippine Route 2 frequency to permit Northwest to provide all-cargo service in the U.S.-Manila market. Northwest states that it will use the frequency to reinstate its second weekly all-cargo flight in the market.
Northwest had previously held 2 weekly frequencies for its Philippine all-cargo service (see Notice of Action Taken dated September 21, 1999 in Docket OST-98-4267). Pursuant to the standard dormancy conditions on that allocation, one of the frequencies became dormant and automatically reverted to the Department in the- summer of 2000.

Beginning April 1, 2001, under Section C.2. of Annex IV of the Agreement, carriers of Turkey may operate to four gateway points in the United States and serve a total of fifteen additional points in the United States on a codeshare basis -- five more points than under the initial year of the transition period. Consistent with this transitional provision of the Agreement. America West's application gives the Department the opportunity to step up and take action that will have an immediate and direct pro-competitive impact on the market and benefit consumers traveling between LaGuardia and the West. To permit the fares for thousands of passengers who travel in these markets to be effectively controlled by a perimeter rule that has long outlived any possible benefit is contrary to the dictates of the Airline Deregulation Act and the stated policy of the Department to promote competition. For these reasons the Department should reject the objections and grant the requested slot exemptions.
