The Petition was accompanied by a Motion for Leave to File since the time afforded to seek review of the staff action had expired. Pursuant to Parts 302.6 and 385.31 of the Department's Regulations, answers to the UPS filing would be due on January 29, 2001. In light of the broad assertions made by UPS in its Petition and Motion, additional time is required by DHLWE to prepare its answer. No person will be harmed by this short delay; UPS, the sole petitioner in this docket, has agreed to the extension sought.

U.S.- Brazil All Cargo Charters

By this notice we invite all eligible carriers interested in operating all-cargo charters in the U.S.-Brazil market for the month of February to file applications with the Department, as set forth in this notice, no later than January 29, 2001.

Under the U.S.-Brazil Air Transport Agreement both parties are entitled to operate 750 round-trip all-cargo charters per year (July through June). Under procedures established in Orders 98-4-19 and 98-6-14, and by Notice dated April 13, 2000, for the 2000/2001 charter year, we allocated a portion of the available charters in advance to carriers based on their historic operations and reserved the balance in a charter pool for distribution on a first-come, first-served basis.

Currently there are 105 charters remaining in the charter pool for the balance of the charter year from February I through June 30. Based on the pattern of service by carriers using the charter pool, this will not be sufficient to meet the demand for service for this charter year.

Against this background, we have decided to take special measures to ensure that the charter pool requests of all properly eligible carriers through the remaining months of the charter year can be accommodated to the extent possible. Specifically, we will strictly limit the number of charters available each month and will allocate within those limits. To this end, and taking into account the five months remaining, we have decided to limit the number of charters available for February to 21 charters (i.e., a pro rata portion of the remaining charters).

Given this time-sensitive situation, with respect to charter requests for February, we will require that applications for the month of February be filed no later than January 29. We will allocate the February flights by dividing them equally by the number of applicants to the extent such allocations are equal to or fewer than requested, and allocate the remaining flights using a round-robin procedure on a first-come, first-served basis. 

Consistent with current application procedures, eligible U.S. carriers may apply for up to ten charters for the month of February. Applications for charters above that number must be accompanied by a request for waiver of the ten-charter limit and served on all carriers that have operated charters in the U.S.-Brazil market this charter year. Charter allocation applications must specify the number of Rights requested; the points to be served; the type of aircraft to be used; the type of cargo; dates of the proposed flights; and must be accompanied by a copy of the signed charter contract for the flights requested.

Because of the limited number of charters available for the remainder of the charter year, we will exclude from consideration for February flights those U.S. carriers that currently hold an advance allocation of U.S.-Brazil charters or that hold scheduled combination or all-cargo service authority to Brazil. Thus, carriers still holding charters under an advance allocation will not be eligible to apply for charters from the charter pool for the month of February.  We will soon issue a show-cause order establishing application/allocation procedures for the remaining four months of the charter year, and all carTiers will have a full opportunity at that time to comment on those procedures before they are made final. Therefore, applicants for February charters should limit the material submitted to the information requested by this notice.  We will serve this notice on all U.S. certificated carriers operating large aircraft, the Air Transport Association, and the National Air Carrier Association.
