Gemini Air Cargo, Inc. submits this Reply to the foregoing Answers filed in this docket by Evergreen International Airlines, Inc., Northwest Airlines, Inc., Polar Air Cargo, Inc., and Federal Express Corporation in which asserts the merits of its own application and argues that it should be selected to receive the three Hong Kong fifth-freedom all-cargo frequencies at issue in this proceeding. Gemini concurs with those carriers that have requested the Department to institute a proceeding to select the carrier to receive the frequencies. Gemini is confident of the superiority of its proposal under which it would operate fifth-freedom all-cargo service between Hong Kong and Bangkok. Gemini is prepared to provide whatever additional information the Department may require in order to make its decision regarding these contested rights. Gemini regards a carrier selection proceeding as the best way for Gemini and the other applicants to present their proposals in more detail.

Hereby applies for renewal of its exemption from 49 U.S.C. § 41101 authorizing Polar to engage in scheduled foreign air transportation of property and mail between Miami, Florida, on the one hand, and Caracas, Venezuela, on the other hand, and beyond Caracas to Rio de Janeiro and Sao Paulo, Brazil, and to integrate service to Caracas with services Polar is otherwise authorized to provide pursuant to its exemption and certificate authorities, consistent with applicable international agreements.
Upon receiving its exemption, Polar sought a license from the Government of Venezuela to commence service. Despite the fact that Polar's service was fully authorized by the U.S.-Venezuela Air Transport Agreement, Polar's application with the Government of Venezuela was not approved. Although Polar is not currently using its U.S. exemption authority, Polar wishes to maintain the exemption in effect to enable it to enter the market upon receipt of the requisite license from the Government of Venezuela.

A waiver of the forty-five (45) day notice requirement of 14 CFR 204.7 is warranted and necessary for three (3) reasons: (i) the rural community that Sunrise intends to serve is currently without scheduled air service, which is essential to meet many of the community's basic needs; (ii) the closing of the sale of the stock of Sunrise provided for by the Plan, and the subsequent payment of the Proceeds to creditors, is dependent upon Sunrise receiving DOT and FAA approval to resume FAR Part 121 commuter air carrier operations on or before February 16, 2001; and (iii) the majority of the information being submitted by Sunrise pursuant to §§ 204.3 and 204.4 is the same information, which supported the DOT's previous grant of economic authority to Sunrise.
