Delta Air Lines, Inc. filed an answer in response to the joint application stating that while it does not object in principle to the proposed services, which Delta acknowledges are consistent with our aviation agreements with Japan and Canada, it urges us to pursue assurance from the Government of Japan that similar U.S. carrier codeshare requests to serve Japan will receive " prompt and favorable" consideration. Delta states that during 1998, the Government of Japan " unreasonably and unnecessarily" delayed a request by Delta to conduct third-country codeshare services to Japan through Delta's codeshare arrangement with Korean Air Lines (KAL). The joint applicants filed a reply stating that at the time of Delta's proposed codeshare service with KAL, the Government of Japan did not have a third-country codeshare agreement with Korea.

While we may have valid reason to question the Department's need for extensive additional information, we will comply with your request in order to move the process forward. The continued operations of Yute under the auspices of Flight Alaska unquestionably are in the public interest. Important competition in the State of Alaska, the jobs of current Yute employees, and the benefits of Yute's operations to the US Postal Service all are dependent upon prompt approval of the transfer by the Department. Indeed, the only answer to the joint application, filed by Arctic Transportation Services, one of Yute's competitors, did not oppose the application but merely opposed expedited treatment. That position was taken with the knowledge that in this case delay effectively amounts to disapproval and with it a reduction of actual competition in Alaska.

Gemini has completed polling the U.S. carriers on the service list for the above application. None of the carriers has any objection to the Application. Attached is a copy of the Codeshare Agreement between Gemini and Qantas as executed. There are no substantive differences between this agreement and the unexecuted agreement attached to the original Application. The changes have been such things such as updating the flight schedule, the dates, the list of aircraft, etc.

Ghana Airways hereby applies for an exemption to provide scheduled foreign air transportation of persons, property and mail between Accra, Ghana and Washington, D.C. Service would be provided twice weekly and would be operated on a coterminal basis with Ghanair's current flights to New York. Ghana Airways will use Baltimore/Washington International Airport for its Rights to the Washington, D.C. area. The proposed flights will be operated with Ghanair's DC 10 aircraft, configured for 272 seats (34 business and 238 economy). Ghana Airways would not carry any local traffic between New York and Washington, D.C. The proposed flights would provide the first and only direct service between Washington, D.C. and West Africa. Currently passengers in the Washington, D.C. area who want to fly to West Africa are given the unenviable choice of changing planes in New York or enduring long and circuitous routings over intermediate points in Europe. Ghanair's proposed same-plane service would allow passengers to leave Washington and arrive in Accra without the hassle of inconvenient connections several terminals apart at New York's JFK airport or camping out in a European airport in order to make a morning connection to Accra.

Sun Country's application has been pending for 60 days. It has drawn comment, but not opposition, from JetBlue Airways. Only the Borough of Queens has opposed tile application. As shown herein, that opposition relies on grounds that will vanish when Air 21 is signed into law. The Department should deem the 60-day application process provided in Air 21, § 231(a)(1)(i) to have been satisfied, and grant immediately the two slot exemptions requested by Sun Country.

Continental Airlines, Inc. responds to the March 17, 2000 letter from the Air Carrier Association of America supporting the complaint of the American Society of Travel Agents and saying "[a] carrier that does not disclose a fuel surcharge until a consumer has made a reservation, has engaged in an unfair and deceptive practice." Continental does not engage in this practice. Continental provides full price information, including any fuel surcharge, to consumers when they price an itinerary and before they purchase air travel. Continental's fuel surcharge is lawful and fully consistent with the Department's regulations and policies.
