Exemption from 49 USC section 41301 to permit Air Georgian to conduct, for a period of one year: 1) scheduled, combination services between any point or points in Canada and any point or points in the United States; and 2) charter operations, carrying persons, property and mail, between Canada and the United States and other charters pursuant to 14 CFR Part 212. Also, Air Georgian requests a Statement of Authorization, under 14 CFR Part 212, to display Air Canada's designator code, for an indefinite period, on flights operated by Air Georgian between any point or points in Canada and the eight U.S. coterminal points Syracuse, New York; Rochester, New York; Albany, New York; Dayton, Ohio; Grand Rapids, Michigan; Louisville, Kentucky; South Bend, Indiana; and Akron, Ohio. Air Georgian proposes, in the conduct of its U.S. operations, only to use equipment designed to have a maximum seating capacity of not more than 60 seats and a maximum payload capacity of not more than 18,000 pounds. Together with its application, the applicant filed a motion requesting the Department to withhold its financial submissions from public disclosure.

The Department should not countenance an indefinite delay of U.S. carrier code sharing to Vietnam manufactured by Northwest for its own purposes. The final date for answering the pending applications is April 5, 2000, based on the additional service of their applications made by United and Delta on March 21, 2000. The Department should direct Northwest to file any application it may wish to present for Vietnam third-country code-share authority no later than April 5, 2000. If no such application is filed by that deadline, the Department should immediately thereafter grant in full the uncontested applications of United and Delta.

Since October 1, 1999 and pursuant to NOAT issued herein on August 17, 1999, JALways has displayed the "JL" code of Japan Airlines on flights operated by JALways between Tokyo, on the one hand, and Kona and Honolulu, on the other. As stated in its July 26, 1999 application herein, JALways will cease operating these flights after March 31, 2000. Accordingly, JALways will no longer codeshare in these markets with Japan Airlines after that date.

Northwest intends to operate a once weekly service in all three markets covered by this application during the winter season, beginning on or about December 16, 2000 and until on or about April 7, 2001. Northwest will serve the Minneapolis-Santo Domingo and Minneapolis-Punta Cana markets with B757 aircraft configured with 190 seats (14 first class and 176 economy class) from its present fleet or as Northwest shall hereafter acquire. Northwest's Detroit-Cancun flights will be operated with A320 aircraft configured with 150 seats (12 first class and 138 economy class). Northwest does not anticipate any difficulty obtaining fuel for these once a week seasonal operations.

By Order 96-9-16 the Department issued Polar Air Cargo a certificate of public convenience and necessity to provide scheduled all-cargo service between a point or points in the United States and a point or points in Thailand (Route 705), and allocated it two weekly all-cargo frequencies for this service. That award was subject to the condition that Polar must begin service with the frequencies by April 1, 1997. Once service was implemented, the frequencies were subject to a 90-day dormancy condition whereby the frequencies would expire and revert automatically to the Department if they were not used for a period of 90 days. Since then, the Department has granted extensions of the startup date for Polar's second frequency through December 31, 1999. (See Orders 97-5-6 and 98-1-6 and Notices of Action Taken dated June 15 and November 13, 1998, and November 10, 1999.) Polar's first frequency automatically reverted to the Department after not being used for a period of 90 days. Polar states that because economic conditions have continued to impede Polar's ability to restart its Thailand service, it seeks a further extension of the startup date for its one frequency to September 30, 2000. Polar indicated that it will resume service to Thailand as soon as market conditions warrant.
By Order 96-9-16 the Department allocated U.S.-Thailand all-cargo frequencies to the following U.S. carriers: United Parcel Service - 6. Air Micronesia - 5, Polar Air Cargo - 2 (one of which has reverted to the Department), Northwest - 3 (in addition to 2 previously awarded), and Federal Express - 5 (in addition to 1 previously awarded). Under the terms of the Department's order, the frequency allocations would expire automatically on April 1, 1997, and revert to the Department for Polar's extension of the startup deadline is effective until September 30, 2000, or until the date on which Polar begins service with its frequency, whichever occurs earlier. If Polar does not begin service by September 30, 2000, its frequency allocation expires automatically. The 90-day dormancy condition with respect to this frequency will begin on the date Polar inaugurates service.
